664 ARTICLE 3.

so appointed shall visit every place of business in his district, the proprie-
tors whereof are required to have licenses immediately before the May and
December terms of the court, and shall require the proprietor of each
place of business to produce a license; and in case of a refusal to pro-
duce the same, the constable shall arrest the proprietor so refusing and
take him before a justice of the peace, who shall take recognizance from
him, with security, to appear before the next term of court to answer the
charge of selling without a license; and if upon trial of such person so
recognized, he shall produce a license, the court may, in its discretion,
cause the party indicted to pay the cost of the prosecution as a punish-
ment for his refusal to produce the license when required by the con-
stable; and the said constables shall return to the grand juries for the
said terms of the Circuit Court lists of all places of business in their
respective districts, which list shall contain the names of persons doing
business at each place, the character of business, the date of the license,
which shall include the year for which it is issued, and the name therein.
Each constable appointed by the County Commissioners as inspector of
license shall receive from them a fee of ten cents for each license in-
spected by him, on making affidavit that he has personally inspected said
license.

402. Constables in Baltimore County shall be entitled to the fees
prescribed by law for the particular service rendered by them; pro-
vided, that no constable in said county shall be entitled to receive from
the County Commissioners not more than fifteen dollars in fees for his

services in criminal cases in any one month, except in the Ninth Election
District of Baltimore County, where he or they shall be entitled to receive
not more than thirty dollars; and provided further, that no constable shall
be entitled to receive any fee in connection with the case of any person
charged with violating the provisions of Chapter 397 of the Acts of 1892.
No constable shall deputize any person in the service of any writ what-
ever for him or in his behalf.

403. The justices of the peace in Baltimore County shall be entitled
to charge for their services in criminal cases the following fees: For
issuing each State writ, twenty-five cents; and for issuing summons for
witnesses, including all witnesses ordered by the same party or side at one
time, twenty-five cents, provided that if more than five witnesses be or-
dered by the same party or side at one time, then the justices of the peace
shall be entitled to receive twenty-five cents additional for each five wit-
nesses, or less than five so summoned; for each oath or affidavit, ten cents;
for each hearing or trial, one dollar; for every commitment, twenty-five

cents; for every release, twenty-five cents; for taking recognizances, in

each case reported to the Circuit Court, twenty-five cents; for taking
