5254 ARTICLE 24.

receiving the largest number of votes for the office for which they were
respectively voted. And said certificate of election from the -clerk of the

court shall be recorded by the town clerk among the proceedings of the
Council; each judge of election shall receive three dollars for his or her
services as such.

202. The Mayor elect and also each Councilman elect shall without
delay appear before the Clerk of the Circuit Court for Worcester County,
Maryland, and make the oath or affirmation and declaration prescribed by
the Constitution and having secured from said Clerk a certificate of his
or her said declaration and oath, shall return the same to the town clerk
to be recorded among the proceedings of the Mayor and Council. And if
any such person so elected Mayor or Councilman shall fail to qualify as
above required on or before the first Monday in May next succeeding his

or her election, the office to which he or she was elected shall be declared
vacant and the vacancy shall be filled in the manner hereinafter provided
for the filling of a vacancy in said office. If any vacancy shall happen in
the office of Councilman by reason of resignation, death, removing from
office, change of residence, failure to qualify or otherwise, the remaining
Councilmen shall appoint some person having the qualification required
for Councilman of Pocomoke City to fill the vacancy until the next annual

election of town officials, at such election, the qualified voters shall elect
a person to fill such unexpired term, but in case of a vacancy in the office
of Councilman, if the two remaining Councilmen can not agree in the
appointment of a person to fill the vacancy, or if they shall fail or neglect
to make such appointment for two months after the occurrence of such
vacancy, it shall be duty of the Mayor to appoint some person having the
qualification required for Councilman of Pocomoke City to fill said va-
cancy until the next annual town election, when such vacancy shall be
filled by the election of some person by the qualified voters; and in case
of a vacancy in the office of Mayor, the Councilmen shall elect some per-
son having the qualification for Mayor of Pocomoke City as hereinbefore
set forth to be Mayor of Pocomoke City until the next annual election of
town officers, at which election, the qualified voters shall elect a person to
fill such unexpired term.

203. The Mayor shall see that the ordinances are duly and faithfully
executed and observed, and in the month of May in each and every year
he shall report to the Council the general state of the town, with an accu-
rate account of the money received and expended, and such account shall
be published in one or more of the newspapers issued in said town not
later than the fifteenth day of June in each year, and in such report to
the Council it shall be his duty to make such suggestions as are proper
for the wise, prudent and economical government and management of the
town; and all ordinances and by-laws passed by the Council shall be sent
