ment or attempted enforcement of the ordinances of the town an appeal
shall lie by the party aggrieved to the Circuit Court for Worcester County;
provided, the same is prayed within five days and accompanied by a bond
to be approved by the said lower Court for the payment of the fine and
all costs in case the judgment be affirmed.

29. The Mayor and Council may, when they deem such an officer nec-
essary, appoint a night watchman, and may by ordinance or by note in
the minute book fix his term of office, his salary and his duties. Said night
watchman, when so appointed, before entering upon the discharge of his
duties, shall take and subscribe before the Mayor the same oath herein
required to be taken and subscribed by the policeman. And he shall have
all the police powers of a constable, and any person resisting him in the
discharge of his duties shall be liable, upon conviction, to the same pen-
alties as are imposed for resisting a constable. And he shall have power
to serve, deliver or post all orders or notices that under any law or ordi-
nance are to be served, delivered or posted, and to make returns thereon
to the Mayor, the Council or the Mayor and Council, and his return there-
to shall have the same force and effect as is hereinbefore given to the
return of the policeman to any such notice. He shall have the same power
for making arrests, and for serving the warrants or writs for criminal
offenses issued by Justices of the Peace, for any offense against the ordi-
nances of the town or the laws of the State, if the said offense is com-
mitted within the corporate limits of said town, as are hereinbefore con-
ferred upon the policeman of Berlin. Special policemen may be appointed
from time to time by the Mayor, with the consent and approval of the
Council, for a term not to exceed one week, when it is deemed necessary
for the good order and peace of the town, all of whom shall be vested
with the police powers of a constable, and resisting them in the discharge
of their duties shall be punished in like manner and to the same extent
as resisting a constable; and the Mayor and Council shall prescribe the
duties and fix their compensation, either by ordinance or by note entered
in their minute book.

30. The Mayor and Council may have the sidewalk and gutters of
any street, lane, alley or thoroughfare of Berlin or any part of either side
of any such street, lane or alley paved with such material and in such
manner as they think proper. Whenever they deem it expedient, right
and requisite that the sidewalks or gutters of any street, lane, alley or
thoroughfare shall be paved, wholly or in part, they may pass an ordi-
nance requiring the said paving to be done under the provisions of this
section and shall notify the parties owning the property in front of which
the improvement is to be made and arrange with them for the payment
of the expense thereof, but if no satisfactory arrangement can be made
then they shall by order appoint three discreet and disinterested residents,
