5144 ARTICLE 23.

said owner of said mare, without the consent of the owner of said stallion
first had and obtained in writing, shall remove such mare or foal out of
the county where said contract is recorded, or shall secrete, destroy or
sell the same, - he shall be deemed guilty of a misdemeanor, and upon
indictment therefor and conviction thereof, shall be fined or imprisoned,
or both, in the same manner and to the same extent as provided for
offenders against the provisions of section 210 of article 27 of the code
of public general laws, title "Crimes and Punishments." This section
shall apply only to the counties of Wicomico, St. Mary's, Worcester,
Caroline and Anne Arundel.

392. If said service money shall not be paid, the owner of said stallion,
upon applying to some justice of the peace of the State, in and for the
county in which the owner of said progeny resides, and swearing to the
correctness of his claim, shall have issued a writ of fieri facias upon the
said progeny, which writ shall be directed to some constable or other
officer, who thereupon shall seize said progeny and sell the same under
the provisions of the code of public general laws regulating sales under
execution from justices of the peace.

393. After the expenses attending such sale, and the amount of the
lien upon said progeny have been satisfied, the balance, if any, shall be
paid to the owner of such property sold.

394. In all criminal cases in the Circuit Court for Wicomico County,
in which the State's Attorney shall appear for the State of Maryland,
an appearance fee for said State's Attorney, as now allowed under the
existing laws of this State, shall be taxed as part of the cost by the Court
trying said cases, and be collected by the clerk of the Court of said county
as other costs are collected, and when collected from the party or parties,
liable therefor, shall be paid over by the clerk to the County Commis-
sioners of Wicomico County.

395. The State's Attorney of said Wicomico county in lieu of the fees
heretofore received by him in any criminal or misdemeanor case or cases
heretofore received by him, as provided by any local law for Wicomico,
county, or in any general law of the State, shall receive a salary of four-
teen hundred dollars per annum as full compensation for his entire
services in such cases as required of him by law, or which may hereafter
be required of him, the said salary to be paid to him by the County Com-
missioners of Wicomico County.
