5116 ARTICLE 23.
pumping station, or for any other purpose in connection with the water
and sewer systems of the City of Salisbury; and whenever resort shall be
had to condmenation proceedings, the proceedings shall be as provided by
Article 33A of the Annotated Code of Maryland, regulating the procedure
for the acquisition of property for public use by condemnation, and all the
rights, powers and privileges conferred by said Article, relating to the
condemnation of property for public use, are hereby expressly conferred
upon and vested in the Mayor and Council of Salisbury, acting by and
through the agency of the said Commission. At any time after ten days
following the return and recordation of the verdict or award in said pro-
ceedings, the Mayor and Council of Salisbury, acting by and through the
agency of the said Commission, may enter and take possession of the prop-
erty so condemned, upon first paying to the Clerk of the Circuit Court for
Wicomico County the amount of said award and all costs taxed to date,
notwithstanding any appeal or further proceedings upon the part of the
defendant; at the time of said payment, however, it shall give its cor-
porate undertaking to abide by and fulfill any judgment on such appeal or
further proceedings.

324. As soon after organization as possible and from time to time
thereafter, the Commission shall cause surveys, studies, plans, specifica-
tions and estimates to be made for water supply, sewerage and storm
water drainage systems in all those parts of the City of Salisbury in which
there is, in its judgment, a need for water supply, sewerage or drainage.
Whenever plans shall have been completed for a water supply, sewerage or
storm water drainage system, or any part thereof, in any part of the City
of Salisbury, and the Commission shall have decided, after an opportunity
for a hearing has been given, to proceed with the construction thereof, it
shall advertise by notice in such newspaper or technical press as it may
deem proper for bids for the construction of said system or systems, in
part or as a whole, as in its judgment may appear advisable. The con-
tract shall be let to the lowest responsible bidder, or the Commission may
reject any and all bids, and, if in its discretion the prices quoted are
unreasonable, it may readvertise the work, or any part of it, or may do any
part or all of the work by day labor; provided, that at any time, the Com-
mission may, in its discretion, expend by day labor for construction work
an amount not exceeding one thousand dollars without advertising or re-
ceiving bids. The Commission may, however, purchase the necessary pipe,
fire hydrants, valves, specials, tanks, pumps, motors, engines or such like
equipment if, in its discretion, it deems it advisable and may advertise as
aforesaid for bids for the construction, alteration and extension of any
other units in part or as a whole, using said equipment, as in its judgment
may bo deemed advisable. All such contracts may be protected by such
bonds, penalties and conditions as the Commission shall require, all of
which shall be enforceable in any Court having jurisdiction.
