5106 ARTICLE 23.

in Wicomico county, and State of Maryland, and to levy and collect taxes
for the payment of the same," are hereby declared to be valid, legal and
binding and of full force and effect as if herein fully set forth. And
chapter 400 of the Acts of 1904, entitled "An Act to authorize the Mayor
and Council of Salisbury to borrow ten thousand dollars and to. issue
bonds for the payment of the same for the purpose of grading and paving
the streets and roadways of Salisbury and to levy a special tax for the
payment of said bonds," be and the same is hereby expressly repealed.

305. All the provisions of chapter 82 of the Acts of the General As-
sembly of Maryland, passed at the January session of 1876, entitled "An
Act to preserve and define the harbor at Salisbury and the channel of
the Wicomico river, in Wicomico county," are hereby continued in force;
provided, that the wharf, as it now stands, erected by William B. Tilgh-
man and Randolph Humphreys in the year 1887 and fronting on the
south branch of the Wicomico river, shall be the harbor line at said point.

306. The Mayor and Council of Salisbury shall have power and au-
thority to establish, own, control, operate, maintain and manage any one
or more of the following named public utilities, to wit: a wharf for the
use of the said City; a public market; a plant or plants, a system or
systems for supplying water or light or both to and for the said City and
the inhabitants thereof. And the said The Mayor and 'Council of Salis-
bury shall have power to provide by ordinance for the establishing, own-
ing, controlling, operating, maintaining and managing of such public
utilities of any one or more of them, provided, however, that the pro-
visions of Section 260 of the Charter of Salisbury shall apply to the
purchase or sale of any such property.

The Mayor and Council of Salisbury shall have power to purchase or
to condemn as hereinafter provided, any property of any description
whatsoever, in fee or otherwise, for the purpose of establishing, owning,
controlling, operating, maintaining or managing any such public utility
and such purpose shall be deemed to be a public improvement within the
meaning of Section 309 of the Charter of Salisbury.

307. To encourage manufacturers in the City of Salisbury, the Mayor
and Council are authorized when they see fit so to do, to exempt the plant
of any manufacturing company or association hereafter located within
the corporate limits of said City from taxation for corporate purposes
for a period not exceeding five years but any ordinance, resolution or
contract which exempts any property, except such as a manufacturing
plant or for a period longer than five years, shall be absolutely null and
void in all respect whatever.
