278. Upon complaint in writing and a trial before the Mayor and
and Council, after notice to the party complained of informing him of
what he is charged and to appear and defend himself first having been
given him in writing at least five days before trial, and if Council find
any of said officers including the clerk to the Council, treasurer or col-
lector as hereinafter provided for, to be guilty of misconduct unbecoming
an officer, disobedience, neglect of duty, misfeasance or malfeasance in
office, such officer may be removed at once from his office by a majority
vote of the trial board and his office shall be declared vacant, and the
Mayor shall, as soon as convenient thereafter, appoint another person to
fill said office so vacated for the unexpired term, which appointment shall
be submitted to the Council for confirmation, and when confirmed the new
appointee shall take the same oath of office as taken by the removed officer
and in the same manner, and to be returned to the clerk of the Council
and recorded as heretofore provided, and the new officer shall have the
same powers and duties as if he had been appointed in the first place and
serve out the term of the removed officer.

279. At the first regular meeting in July, 1928, and at the same time
every second year thereafter the Mayor shall appoint, subject to confirma-
tion by the Council, one person, a resident and qualified voter of this
City, not a member of the Council, to act as Clerk to the Council, Col-
lector of City taxes and Treasurer who shall be the same person and whose
term of office shall be two years and until his successor is duly qualified.
The said officer shall receive such salary as may be fixed by the Mayor
and Council not to exceed Eighteen Hundred Dollars per year; and he
shall perform all the duties imposed on him by law or ordinances of the
City, and shall be called "Clerk of Salisbury." For the purpose of per-
forming his duties as Collector of City Taxes and Treasurer, the person
appointed as Clerk of Salisbury shall keep his office open for the trans-
action of business from eight o'clock in the morning until five o'clock in
the afternoon every week-day, except legal holidays, and for the purpose
of performing his duties as Clerk to the Council, he shall be on duty at
such time or times as the Council shall determine upon.

280. The said clerk, treasurer and collector, before entering upon the
performance of the duties of his office, shall take and subscribe to an
oath before a justice of the peace residing in said city that he will well
and faithfully perform the duties of his said office according to law and
the ordinances of said city, which oath is to be returned to the Council
and recorded as provided for the oaths of other officers, which oath,
record of same or a copy thereof are hereby made evidence in any court
of this State. He shall give bond to the State of Maryland in an amount
at least equal to the amount of taxes levied with a fidelity or surety com-
