5086 ARTICLE 23.

cuit Court for Wicomico county, that he will diligently and faithfully
without partiality, favor or prejudice, well and truly perform the duties
of Mayor or Councilman of said city, as the case may be, which oath shall
be recorded in the office of said clerk, and a certificate of which oath shall
be returned by said clerk to the Mayor and Council of said city and
recorded amongst the proceedings of said Council, both of which records
or a certified copy of either of them under seal may be used as evidence
in any court of the State.

269. If any vacancy shall occur in the office of Mayor or Councilman
by death, removal, resignation, failure to qualify or otherwise, the re-
maining Councilmen at their next regular meeting, or a meeting called
for that purpose, shall elect a qualified person to be Mayor or Councilman,
as the case may be, to fill such vacancy or vacancies, to serve until the
next election and until his or their successor or successors are qualified,
who shall take the oath hereinbefore prescribed and in same manner,
which oath shall be certified to and recorded in proceedings of the Council
in same manner as if they had been originally elected to said vacant office,
and at the next annual election the qualified voters shall elect a qualified
person to fill the said vacancy for the unexpired term.

270. All ordinances and by-laws passed by the City Council shall be
delivered by the Clerk of the Council at once, or as soon as conveniently
may be, to the Mayor for his approval. He shall return the same to the
Clerk of the said City Council within six days after delivery to him, in-
clusive of the day of delivery and its return, with his approval or dis-
approval; and any ordinance or by-law returned by the Mayor without
his approval shall not become a law unless subsequently passed at a meet-
ing by four-fifths of the whole Council, and within twenty days from the
time of the return of the said ordinance, and if he shall fail to return
same within six days of its delivery as aforesaid, then the said ordinance
or by-law shall become a law without his approval. The Mayor shall see
that all ordinances and by-laws of the City be strictly enforced; he shall
after each annual election report to the Council the condition of municipal
affairs, with such recommendations as he deems proper for the public
good and welfare of the City; he shall appoint the officers herein pro-
vided, and he is hereby given full control of the police officers who shall
receive orders from him and execute them according to law and ordi-
nances. The Mayor when he deems it to the best interest of the City and
for cause may suspend any police officer without pay for a period not
exceeding one month. He shall report to the Council his action and if he
deems it advisable for the best interest of the City, he may prefer charges
against such officers to the Council, who shall try said officers as herein
provided. And the Mayor shall receive an annual salary of Six Hundred
Dollars.
