whatsoever to go to any certain place, or any certain distance, and shall
secretly use said horse, mare, gelding or vehicle for a greater distance or
in going to some other place with the intent to evade payment for such
increased use; and shall fail, or refuse to immediately pay the said livery
stable keeper a reasonable compensation for the additional use of said
horse, mare, gelding or vehicle, which additional compensation shall be
rated in proportion to the increased distance and use, such person shall,
on conviction before any justice of the peace of Wicomico County, forfeit
and pay a fine of not less than five dollars nor more than twenty-five dol-
lars, and upon failure or refusal to pay said fine and costs shall be com-
mitted by such justice of the peace to the jail of Wicomico County for a
period not exceeding thirty days; and in case the judgment of the justice
of the peace is against the accused, he shall have the right of appeal to the
Circuit Court for Wicomico County upon entering into recognizance with
security to be approved by the justice of the peace, and in every such case
the appeal shall be taken within thirty days after the date of his conviction.

136. It shall not be lawful for stock of any kind to run at large in
Quantico, nor within the following described limits: Beginning at the
bridge across Quantico Creek on the south side, and the residence of
Willie Grillups on the west, and to the woods on the new road through the
farm of John Dorman on the east.

136A. It shall be the duty of any constable or officer of the law to take
up and impound any stock which may be found going at large, and any
constable or officer of the law so taking up and impounding shall notify a
justice of the peace resident within said county, who shall give notice of
said impounding by advertisement set up at one or more public places,
describing the stock so impounded and same will be sold at public auction
at some place in said limits within four days; provided, that if the owner
of any stock impounded under this section shall prove to the satisfaction
of the justice that said stock did not go at large from negligence or want
of care on his part, and that due diligence was used to prevent it, he
shall have return of the property on paying the justice of the peace such
fees as he would receive for similar work, as is provided in the Estray law.
The constable shall receive fifty cents for taking up of each "Stock.
He shall also receive for board as follows, viz: Horses and mules fifty
cents per day, cattle thirty cents and swine ten cents per day.

137. Out of all monies arising from the execution of the preceding
section the justice of the peace shall collect and pay to the party taking
and impounding said stock such fees as are prescribed in the preceding
