on which fences along the said turnpike now stand, but nothing in this
Act shall be construed to prohibit the erection or repair of fences on the
lines on which they now stand.
Any person violating the provisions of this section shall be guilty of a
misdemeanor, and upon conviction thereof shall be fined a sum not exceed-
ing one hundred dollars.

722. The County Commissioners of Washington County in their dis-
cretion are hereby authorized in any case when it is made to appear to
their satisfaction that sufficient responsible subscriptions have been ob-
tained for the payment of two-thirds of the costs of the building of a turn-
pike along the line of any public road within the bounds of said county,
to subscribe for an amount of the capital stock of any company organized
for the building of any such pike, the residue, or other one-third of the
cost necessary for the completion of said pike.

723. To enable said commissioners to raise money to meet and pay any
subscriptions for the capital stock of any turnpike company so made by
them they are hereby further authorized to issue bonds in such denom-
inations and amounts as they may determine upon, the same to be payable
within ten years from date of issue, and to bear interest not exceeding
four per cent., or they may levy direct to raise money for the payment of
said subscription.

724. In case the said county commissioners issue any bonds as afore-
said they shall have full power and authority to pay, levy for the re-
demption of said bonds, principal and interest as the same becomes due
and payable.

725. The inhabitants of Sharpsburg, in Washington county, State of
Maryland, are hereby created a corporation, by the name of the Burgess and
Commissioners of Sharpsburg, and by that name shall have perpetual suc-
cession, may sue and be sued, may have and use a common seal, and possess
such other incidents and powers as attach by law to a municipal corpora-
tion ; and may purchase and hold real, personal and mixed property for the
benefit of said corporation; provided, however, the Burgess and Commis-
sioners shall not purchase or acquire any real estate unless they shall first
provide by ordinance for said purchase and the mode and manner of pay-
ment therefor; and all ordinances for the purchase of real estate shall pro-
vide for submitting the question of said purchase to the qualified voter of
the town in an election to be held as hereinafter provided for town officers,
