for said property and all property rights, streams of water, drains and
sewers and rights therein with the owners thereof or after the amount
has been awarded to the said owners under and by virtue of the con-
demnation proceedings set forth in Section 460 of this subtitle, if the said
award be accepted by the said Mayor and Council, shall levy a sum of
money upon the assessable property of Hagerstown sufficient to pay for
the said tract or tracts of land and improvements thereon together with
all streams of water, easements, sewers, drains, water-ways, water rights,
water courses and the rights therein of all persons and corporations or
in any wise appertaining thereto so agreed upon or awarded in said con-
demnation proceedings, at the time of the making of the annual levy of
taxes by the said Mayor and Council and to be included therein.

462. After the completion of said purchase or the acceptance of the
award by condemnation of said land and the title thereto has been fully
acquired, as aforesaid, the Mayor and Council of Hagerstown shall be of
the opinion that any part of said lands and property are unnecessary
for the complete and proper carrying out of the provisions of this Act the
Mayor and Council of Hagerstown is hereby authorized and empowered
to sell and dispose of any such part thereof for the best price obtainable,
the proceeds arising therefrom to be credited by the Mayor and Council
to the General Purpose Account Fund, the same to be paid out as set
forth in the Charter of Hagerstown in such case made and provided.*

463. After the sale of the plant of The Washington County Water
Company shall have been approved by a majority of the stockholders of
said Company and the purchase of said plant shall have been approved
by a majority of the qualified voters of Hagerstown in the manner here-
inafter set forth at a price based upon the valuation to be fixed by the
Public Service Commission of Maryland, the said Mayor and Council of
Hagerstown is hereby authorized and empowered to acquire by pur-
chase, the entire plant of the said Washington County Water Company,
including all of its real and personal property, rights, privileges, waters,
streams of water, waterways, watercourses, easements and franchises sub-
ject to the provisions of this Act, at and for said price to be fixed as the
valuation of said plant by the Public Service Commission of Maryland,
together with such additions and extensions to said plant as may be made
by said Washington County Water Company between March 1, 1918, and
the date of the final consummation of said purchase at the cost price of
said extensions and additions as is more fully provided in Section 475
of this sub-title.
*Sec. 5, ch. 71, 1916, repealed all Acts inconsistent therewith.
