cadamizing, paving and repaving of streets and highways of the City of
Hagerstown, Maryland, said work to be done under the supervision of the
Board of Street Commissioners and the materials used to be purchased by
said Board subject to the approval of the Mayor and Council of Hagers-
town.*
CONDEMNATION.
1912, ch. 95, sec. 1.
448. The Mayor and Council of Hagerstown, Maryland, a corporation
existing by virtue of an act of the General Assembly of Maryland, is
hereby authorized and empowered to acquire, by purchase or condemna-
tion, in manner and form as hereinafter provided in this act, a lot of
ground commonly known as the "Oak Spring Lot," and all property
rights therein, situated on the southeast corner of West Franklin street,
in Hagerstown, Maryland, and a public alley running from West Wash-
ington street to West Franklin, street and commonly known as the "Bald-
win House Alley," for the erection thereon of a building for housing ap-
paratus for fire protection or any other municipal purposes for which said
building may be designed. And the Mayor and Council of Hagerstown
are further authorized and empowered to do any and all other things
enumerated in this act, and are further authorized, and empowered to do
all other things which may be incidental to or a necessary consequence of
"the power and authority conferred upon the said Mayor and Council of
Hagerstown by the terms of this act.

449. The Mayor and Council of Hagerstown shall have the right and
authority to purchase said lot of ground described in Section 448 and all
property rights therein from the owner or owners of said property and
property rights, if it can be definitely, accurately and positively de-
termined who are the owners of said property and property rights, at
such price or prices as may be mutually agreed upon between the owners
of said property and property rights and the Mayor and Council of
Hagerstown, and for the purpose of purchasing said lot and property
rights the Mayor and Council of Hagerstown are authorized to act with-
out submitting the matter of said purchase to the qualified voters of the
City of Hagerstown, but the act of the Mayor and Council of Hagerstown
in the purchase of said lot shall be conclusive and final, and upon the pay-
ment of the purchase money and the passage of deeds or other proper legal
instruments of conveyance, title to said lot and property rights shall vest
in the Mayor and Council of Hagerstown as fully and to the same extent
as if the purchase of said lot had been ratified by the vote of the qualified
voters of Hagerstown. The Mayor and Council of Hagerstown are fur-
ther authorized and empowered to make such necessary improvements on
said lot as in their judgment may be deemed necessary, and to pay for
