4818 ARTICLE 22.

1918, ch. 40, sec. 4.

421. Any person violating any of the rules and regulations adopted by
the said Park Commission shall upon conviction thereof before any one-
of the police justices of Hagerstown, said justice may impose a fine of
not more than $50.00 and costs for each offense and upon failure to pay
said fine and costs, the said justice may commit the offender to the jail
of Washington County for a period of not more than twenty days; all
such fines shall be paid to the Park Commission to be used exclusively
for the maintenance of said Park.

422. The said Mayor and Council of Hagerstown, Maryland, is hereby
authorized and empowered to acquire land to be used for a Park either
by purchase or by condemnation proceedings, within or without the cor-
porate limits of the town of Hagerstown, as in its judgment it may deem
best, the same if without the corporate limits of said town of Hagerstown
to be as near the corporate limits as possible, with full power to the said
Mayor and Council to use its best judgment in the selection of the said
land for a Park.*

423. The said Mayor and Council are hereby authorized and empow-
ered to levy annually taxes upon the assessable property located in said
town to an amount sufficient to maintain the said Park.

1914, ch. 286, sec. 10.

424. The Mayor and Council of Hagerstown shall not purchase any
real estate to be used for park purposes, nor issue any bonds under the
provisions of this Act, unless the said Mayor and Council shall first pro-
vide by ordinance for said purchase, and the mode and manner of pay-
ment therefor; and all ordinances for the purchase of real estate, to be-
purchased and used for park purposes shall provide for submitting the
question of said purchase to the qualified voters of the town of Hagers-
town at some regular election for the election of Councilmen of said town;
and before any such ordinance shall be submitted to the qualified voters,
of the said town, at least two weeks' public notice shall be given by pub-
lication in one or more newspapers of the said town, of an intention to
submit said ordinance to the qualified voters of the said town, and said
notice shall set forth the ordinance in full and the mode and manner of
payment proposed; and no ordinance for the purchase of real estate to
be used for park purposes shall be of any force or validity until it shall
receive a majority of all the votes cast at such election.

425. The Mayor and Council of Hagerstown is hereby authorized and
empowered to borrow a sum of money not to exceed twenty thousand dol-
