4812 ARTICLE 22.

this Act, and to and for no other purpose or use whatsoever, said fund-
shall be drawn on by the Board of Street Commissioners of Hagerstown,
for all purposes whatsoever properly chargeable to the electric light plant,
and the operation thereof by warrant duly signed by the President of the
said Board of Street Commissioners and countersigned by the Clerk of
the Board.

402. To provide for the sum of money necessary to pay the costs and
expenses of conducting and operating said electric light plant in the event
that the revenues derived therefrom shall not be sufficient for said pur-
poses, the Mayor and Council of Hagerstown is hereby authorized and
empowered to levy annually on every One Hundred Dollars' worth of
assessable property in Hagerstown, an amount sufficient to meet said
deficiency, and the sum of money collected from said levy shall constitute
part of the aforementioned fund, to be known as the "electric light fund,"
and be applied to the payment of the costs and expenses of conducting,
operating, and maintaining said electric light plant, and to and for no
other purpose whatsoever. It is hereby expressly provided, however, that
this levy shall never be made unless the revenues derived from the sale of
electric current to consumers shall prove inadequate to pay the necessary
expenses of the operation and maintenance of said electric light plant.

403. If the revenues derived from the payment by consumers for the
use of electric current shall at any time exceed the sum of money neces-
sary to pay the costs and expenses of operating and maintaining said plant
and making reasonable repairs, extensions and enlargements thereof, the
sum of money remaining on the first day of April, in each year shall be
paid by the Board of Street Commissioners, to the Mayor and Council of
Hagerstown, to be appropriated by said Mayor and Council toward the
payment of the interest on said bonds issued under the provisions of this
Act, and for the redemption of said bonds when due and payable, or to
the purchase in the open market of any of said bonds, and said bonds
when so paid or purchased, shall forthwith be cancelled.

404. In addition to the powers expressly conferred by this Act, ther
Mayor and Council of Hagerstown, shall have such other powers as are
incident thereto, or necessary consequence of the powers herein conferred,
which shall include the right to pass all ordinances, not inconsistent with
the powers granted by this Act, that may be deemed necessary for the
protection and preservation of said electric light plant, or any portion
thereof, and to attach reasonable penalties thereto for violation thereof
to formulate and enforce all rules and regulations necessary for the proper-
