394. If the revenue derived from the payment for services by con-
sumers shall at any time exceed the sum of money necessary to pay the
operating expenses and the cost of keeping the plant in repair and pro-
viding for reasonable extension and enlargement of the plant so as to meet
all legitimate demands, the sum of money remaining on the first clay of
May, in each year, shall be paid by the Board of Street Commissioners to
the Mayor and Council to be appropriated by them to the payment of the
principal and interest or any part of the debt created by the issue of the
bonds issued in accordance with the provisions of Section 386 of this
Article.

395. The Mayor and Council are authorized and empowered to pass
all ordinances, not inconsistent with the terms of this Act, that it may
deem necessary to protect and preserve the plant, and equipment mentioned
and provided by the provisions of this Act.
1900, ch. 75, sec. 13.
396. All claims for services of light against any consumer that shall
be in arrears for the period of thirty days shall be placed in the hands of
the attorney of the Mayor and Council for collection, and suit shall be
brought thereon in the name of Mayor and Council of Hagerstown for the
use of the Board of Street Commissioners, and the provisions of Section
thirty-three of Article 9 and Section eight of Article 83 of the Code of
Public General Laws of Maryland shall have no application to any execu-
tion or attachment issued upon any judgment, recovered in such suit, but
so far as the same may be held to effect any attachment or execution issued
upon said judgment, said sections are hereby revoked and repealed.

397. The policemen of Hagerstown, or any one of them, when thereto
required by the Board of Street Commissioners, shall perform the duties
of collecting the sum or sums of money due by consumers for service of
light provided, according to such regulations as may be determined by the
Board of Street Commissioners.
1900, ch. 75, sec. 15.
398. Whenever it shall become necessary for the said Board of Street
Commissioners to purchase fuel or any materials that may be advantage-
ously purchased in large quantities of bulk, they shall by public advertise-
ment in two or more newspapers of Hagerstown invite bids or proposals
for furnishing the same, and shall award the contract for furnishing such
fuel or material to the lowest responsible bidder, and shall in all cases ex-
act bond with good and sufficient security for the faithful performance of
such contract, and the failure to file such bond with the Board of Street
Commissioners within ten days after award of such contract, shall be suffi-
cient ground for the said Board of Street Commissioners to revoke and
