48 ARTICLE 1.
Provided that any person or persons or corporation conducting a kennel
for the raising and selling of dogs shall register the same with the County
Commissioners and shall pay an annual tax of five dollars ($5.00) for
said kennel, provided all dogs are kept in said kennels, or when taken
therefrom for the purpose of training shall be under the control and cus-
tody of such owner or trainer, and provided, further, that when said dogs
shall be allowed to leave the kennel, and shall not be in the custody or
under the control of said owner or trainer, then all the provisions of the
hereinafter sections shall apply to the same.

133. The County Commissioners, upon the approval of this law, are
hereby empowered and directed to formulate and carry out procedure for
the collection of the said tax and for the distribution to each person or per-
sons paying taxes, as herein provided, a metal tag or tags to be given for
each dog for which the license tax has been paid, with the further power to
call upon any and all persons in said county to disclose the number and
sex of all dogs owned by them in Allegany County. The metal tag herein
referred to shall bear the license number and fiscal year.

134. Any person or persons or body corporate owning, harboring, or
having in their custody and control any dog or dogs who shall fail or
refuse to pay the license tax provided in the preceding sections, or who
shall fail or refuse to place the metal tag upon said dogs after receiving
the same on or before the first day of July in each and every fiscal year,
upon the arrest and conviction before a magistrate, shall pay a fine of
not less than Five Dollars ($5.00) nor more than Ten Dollars ($10.00).

135. It shall be lawful for any person to kill any dog even though
tagged when found chasing or killing sheep, cattle or poultry upon the
lands of any person other than the owner of said dog, or when found
unattended and in an enclosure where sheep are kept, (except on a farm
belonging to owner of said dog) or when found upon the owner's premises
unattended and without a tag bearing the proper license number; and no
person or persons shall have any right of action to recover the value of any
dog killed as herein provided, from the person killing the same.

136. The County Commissioners of Allegany County shall pay to any
person identifying by proper proof a sheep killing dog the sum of Ten
Dollars ($10.00), and when so identified and proved to the satisfaction
of the County Commissioners, the said County Commissioners shall order
the said dog to be killed and no right of remuneration shall accrue to the
owner of said dog. Any owner of a dog, after having been duly notified
by the County Commissioners to kill a sheep killing dog, who fails or
