collector, the amount of benefits so assessed against any lot or parcel of
ground, who shall forthwith enter the same on his books against the prop-
erty so assessed; the tax collector shall collect such benefits as other taxes
are collected; provided, that no property be sold for the payment of bene-
fits until after the expiration of six months from the date of the passage
of the order of the mayor and council in the premises.

355. The notices herein provided to be given by the board of street
commissioners shall apply in all cases, whether the owners of property to
be affected by their proceedings be residents or non-residents, infants,
non compotes mentis, or laboring under any other legal disability.

356. The board of street commissioners shall have charge of all repairs
and improvements of the streets, alleys, highways, lanes, squares, sewers,
sanitary sewers, drains and water-courses of the town; they shall have con-
trol of the expenditure of all money appropriated by the mayor and coun-
cil, and of all the money credited to street repairs and improvements de-
rived from fines and licenses under Section 326, and the levy of ten cents
as provided in Section 362; shall have power to expend said money when-
ever in their judgment the same may be needed, with full power to make
contracts and employ labor at such compensation as they shall determine;
and in no case shall the board of street commissioners expend in any one
year a larger sum in repairs and improvements than the amount appro-
priated therefor.

357. The said Board of Street Commissioners shall have control of the
lighting of the town, with power to provide the material, employ lighters
and other necessary labor, and to make such needful provisions therefor,
and to make such alterations from time to time as they may deem proper
or necessary, with the power to contract with any person, corporation or
association for such lighting; provided, that the cost under any such con-
tract or lighting shall not exceed the sum of seven thousand dollars for any
one year, nor shall such contract be made for a period exceeding ten years;
and to provide the amount of money necessary to pay the cost of any such
contract or lighting, the Mayor and Council are hereby authorized and
directed annually to levy on the assessable property of the town ten cents
on every one hundred dollars' worth of assessable property in said town,
and the money collected from said levy shall constitute a separate fund,
to be kept by the collector of taxes, and be applied to the payment of all
cost or charges under said contract or lighting, and to and for no other
use or purpose, said fund to be placed and drawn out by said Board of
Street Commissioners as directed by Section 322 of the charter of Hagers-
town; and in case the said levy should not be sufficient to pay the cost of
