4790 ARTICLE 22.

vested with power and authority to levy taxes, in addition to the amount
now authorized by law, sufficient to meet the requirement of any contract
executed under the provisions of this section.

330. The mayor and council of Hagerstown shall have and are hereby
vested with power and authority to grant the use of the streets and high-
ways of the town unto any street railway company, the motive power
whereof shall be either horses or electricity and prescribe the terms and
conditions upon which such use shall be allowed.

331. The mayor and council of Hagerstown shall have and are hereby
vested with power and authority to cause to be invested in bonds of Ha-
gerstown, or in other approved security the balance now in the treasury
of said town credited to the sanitary account and from time to time to
reinvest the same together with any interest accruing thereon and- to
credit all proceeds arising therefrom to said "Sanitary Account," until
the same shall be needed for the purposes for which the sum now credited
to said sanitary account, was originally levied.

332. Whenever a property owner has laid a pavement, curb or gutter,
according to a grade given by the Mayor and Council, and any change
may thereafter be made in such pavement, curb or gutter by order of the
Mayor and Council, all costs of such change shall be paid by said Mayor
and Council.

333. Whenever the mayor and council shall exercise the power under
Section 326 to cause the sidewalks, curbs and gutters, or any of them,
along the public streets and highways of said town to be graded, paved,
repaired or improved, and such curbs and gutters to be set and laid, and
shall under or by any ordinance, or order thereof, and in pursuance of
the same, direct the said sidewalks and curbs and gutters, or any of them,
to be graded, paved, repaired or improved, set and laid at the expense of
the abutting property, or the owner thereof, it shall be the duty of the
board of street commissioners, in pursuance of such order or direction,
to grade, pave, repair or improve such sidewalk, and to set the curbs and
lay such gutters, either, all or any, as it may be so ordered; and the cost
thereof to be paid by the abutting property, or the owner thereof, shall
be returned to the mayor and council by the said board of street commis-
sioners, together with their proceedings in the premises, and the said board
shall also make return of the cost thereof to the collector of taxes, who
shall proceed to collect the same as thereunto authorized and directed by
said charter, or by any ordinance passed in pursuance thereof, and the
cost of making the same shall be a lien upon the abutting property; and
