262. If the clerk of the court, any member of the Board of Super-
visors of Elections in Hagerstown, any officers of registration, or judge, of
elections shall lose any registry of voters, which may be in his or their
charge or custody, or if any such officer or any other person shall wil-
fully destroy, mutilate, deface, falsify or fraudulently remove or secrete
any registry of voters, or shall fraudulently make any false entry in or
false copy of any registry of voters, or part thereof, or shall fraudulently
make any entry, erasure, or alteration in any registry of voters or part
thereof, he shall be guilty of a misdemeanor, and upon conviction thereof
shall be punished by a fine not exceeding five hundred dollars, or by im-
prisonment not exceeding' three years, or by both fine and imprisonment
as aforesaid.

263. In case of the vacancy in the position of councilman for any ward,
by death or otherwise, the mayor and council shall order an election to
fill said vacancy for the unexpired term; and said election, when ordered,
shall be conducted in accordance with the provisions hereinafter enacted
in reference to elections of town officers.

264. It shall be the duty of the mayor to publish in not less than two
newspapers published in Hagerstown, at least ten days prior to the day
of holding any such election, notice thereof, which notice shall state the
officers to be voted for, or the object and purposes of such election.

265. The Governor shall, biennially, before the Third Monday in
February, appoint by and with the advice and consent of the Senate, if in
session, and if not in session, by the Governor alone, in the City of Hagers-
town, three persons resident in and voters of said City of Hagerstown,
two of whom shall always be selected from the leading political parties
of the State, one from each of the parties, who shall be men of approved
integrity and capacity, and none of them shall hold office or employment
under the Government of the United States or of the State of Maryland,
and they must not be candidates for office at the next ensuing municipal
election in the City of Hagerstown, or at any municipal election in said
city, within the term for which they or any of them were appointed, who
shall be styled the Board of Supervisors of Election of the City of Hagers-
town; each of said Supervisors shall hold office for two years from the date
of his appointment, and shall exercise the powers and perform the duties
hereinafter set forth; in case of a vacancy occurring in said Board when
the Legislature is not in session, such vacancy shall be filled by the Gov-
ernor; it shall be the duty of said board not later than the Third Monday
of March in each year, to appoint three persons for each ward of said
City of Hagerstown, residents in and voters of such ward, who, or a
majority of them, shall be judges of election for such ward from the time
