thence, sixth, north 33 degrees, west 7 perches, with said road to its inter-
section with Mulberry street, at the northeast corner of a lot owned by
David L. Houck; thence, seventh, north 55 degrees, east 34 1/2 perches,
across the intervening lots to the angle made by a point in an alley at its
outer margin adjoining the land of the heirs of J. T. Snyder, deceased;
thence, eighth, with said alley north 15 degrees, east 18 1/2 perches, to the
northeast corner of the said "State road" on its northern margin; north
80 degrees 20 minutes, east 10 perches, to the place of beginning; pro-
vided, however, that for sanitary and police purposes, the Burgess and
Commissioners of Clearspring shall have and exercise full power and con-
trol for a distance of one-fourth of a mile in every direction from said
corporate limits.

121. The male citizens of said town of the age of twenty-one years
and upwards, having resided therein for the space of six months next pre-
ceding the first Monday in May next, on that day, and on the first Mon-
day in May in each and every year thereafter, are authorized to elect one
burgess, one assistant burgess and three commissioners for said town, said
commissioners to be owners of real estate therein; all persons elected shall
have resided within the limits of said town for at least two years next
preceding the election. The services of said commissioners shall be gratu-
itous and without pay.

122. Jacob Sword, John M. Graybill and John H. Anderson of said
town, are hereby empowered to act as judges of the first election for said
burgess, assistant burgess and commissioners, who shall keep the polls open
from two o'clock p. m. until six o'clock p. m., and the said judges shall
make returns under their hands and seals of the persons elected, to the
clerk of the Circuit Court for Washington County, who shall issue cer-
tificates to the persons so elected; and all subsequent elections shall be held
and conducted in such manner and at such place as shall from time to
time be directed by the by-laws of the corporation, not inconsistent with
this charter; and if any person so elected as burgess, assistant burgess or
commissioner shall refuse to serve as such, or his place shall become vacant
by death, disqualification or otherwise, an election to fill such vacancy
shall be held, of which ten days' notice shall be given; and in case of a
tie between any persons voted for at any election under this act, the clerk
of the court for Washington County shall issue certificates only to the
persons receiving the highest number of votes, and the officers who have
received certificates shall at their first meeting as a board designate one
of the persons receiving such tie vote to be the one elected, and shall notify
the clerk of the Circuit Court of said county of their selection, and the
said clerk shall issue immediately a certificate to such person, which cer-
tificate shall set forth the manner of his election, and said person shall
hold his office for the same time as he would had he received the highest
number of votes.
