instrument in Tangier sound, in Somerset county, passed at the January
session of the General Assembly of Maryland, eighteen hundred and
ninety-four," and such number of ballots with the words, "Against the
act prohibiting the catching of oysters with scoop, scrape, dredge or any
similar instrument in Tangier sound, in Somerset county, passed at the
January session of the General Assembly of Maryland, eighteen hundred
and ninety-four," as may be necessary for all the voters of .Somerset
county; and at the said election, the judges of election shall furnish and
have at the several polling places ballot boxes in which only ballots cast
under the provisions of this act shall be deposited, and after closing the
polls on said day of election, the said ballots shall be counted and returned
to the clerk of the Circuit Court for Somerset county, as in other elections
under the laws of this State; and it shall be the duty of said sheriff and
tho County Commissioners to make all necessary provisions for the carry-
ing out of the requirements of this act, so that said election shall be fairly
held; and if it shall be found by the said Clerk of the Circuit Court, to
whom such returns shall be made, that a majority of the votes cast at said
election are for the adoption of said act, the said clerk shall, within ten
days thereafter, make proclamation of the result, and publish the same
in all the newspapers then published in Somerset county, giving notice
of the adoption of the law, and warning all persons interested therein that
its provisions will be enforced by the officers of county and State; and
the County Commissioners of Somerset county are hereby authorized and
required to provide for the payment of the expenses necessary to carry
ont the provisions of this act, regarding its submission to the vote of the
people as aforesaid; which act shall go into effect and become law, from
after said fifteenth day of March, eighteen hundred and ninety-five, and
not otherwise.*

280. It shall not be lawful for any person or persons to employ any
boat or vessel in catching or taking oysters with scoop or scrape, drag or
dredge, or any similar instrument in the waters of Tangier sound, in Som-
erset county, above or eastward of a straight line drawn from the dwelling-
house of Thomas Tigner, near Hayne's point, to Clay island light-house;
but nothing herein contained shall be construed to prohibit the catching
of crabs.

281. Any person or persons violating any of the provisions of this
act shall be fined in a sum not less than one hundred nor more than two
hundred dollars for each and every offense, and shall stand committed to
the county jail until such fine and costs and charges shall be fully paid
and satisfied, and every and any canoe, boat or vessel captured and con-
victed of violating, or have been used in the violation of this act, shall
be condemned by the justice of the peace having jurisdiction, and shall
