4432 ARTICLE 20.

196. The judgment, assessment and report of the two persons herein-
before provided for, to be appointed by the justice of the peace, shall in no
case be taken and held to be conclusive and final; but either party on
trial shall be at liberty and have the right to produce witnesses to main-
tain or controvert all matters at issue in the case; and the court, before
which the case is to be determined, shall give such judgment, upon all
the evidence, as may seem right and proper; and nothing in this sub-
title of this article contained shall be taken or considered as giving
jurisdiction to any justice of the peace to hear and determine any cause
wherein the title of land is concerned.

197. The provisions of the seven preceding sections shall not apply to
that part of Tangier district which comprises Deal's island, as the same
is now surrounded by water.

198. Any person or persons who shall shoot at or shoot a fox that is
being pursued by a dog or dogs in the limits of Somerset county shall
be guilty of a misdemeanor, and upon conviction thereof before a justice
of the peace shall be fined not less than twenty nor more than fifty dollars
for each fox so shot at or killed, and stand committed until the fine and
costs are paid, one-half of such fine to be paid to the informer, the other
half to the Board of County School Commissioners of said county for the
use of the public schools of said county.

199. Any person who shall dig out or in any manner take from any
den a female fox or her young whelps or kill or in any manner cause the
death of such female fox or her young whelps during the period of time in
which she is sucking them shall be guilty of a misdemeanor, and upon
conviction before a justice of the peace shall be fined not less than twenty-
five dollars nor more than fifty dollars for every female fox or whelp so
dug or taken out of any den, or killed or caused to be killed, and shall stand
committed until such fine and costs are paid, one-half of such fine to be
paid to the informer, the other half to be paid to the Board of County
School Commissioners of said county for the use of the public schools of
said county.
