38. The clerk of the circuit court shall, annually, on or before the first
Monday in April, furnish to and lay before said commissioners, copies
of all such lists, accounts, papers and documents as may be useful and
necessary to them in ascertaining the county charges, according to the
directions he may from time to time receive from them; and on failure
or refusal to comply herewith when required by said commissioners, or
their clerk by their order, he shall forfeit to them, for the use of the
county the sum of one hundred dollars, to be recovered by indictment
in the circuit court for said county.

39. Before any deed for the conveyance of real estate in Somerset
County shall be received for record by the Clerk of the Circuit Court
thereof, the person offering said deed for record shall submit the same to
the Clerk to the County Commissioners of said county, who shall there-
upon .make transfer on the county assessment books of the said property
to the name of the new owner or owners thereof, and as evidence of said
transfer, shall stamp upon the said deed his certificate thereof, and no
deed shall be received for record without said certificate. At the time
of submitting the deed to the Clerk to the County Commissioners, the
person or persons offering the same shall furnish said clerk with a state-
ment of the buildings, if any, upon the land conveyed by said deed, and
the price paid for the property. All Acts or parts of Acts, inconsistent
herewith are hereby repealed.

40. The board of County Commissioners are hereby authorized, em-
powered and required to adopt a scientific and thorough system of drain-
age and general improvement for the public county roads of Somerset
county, whenever the same may be needed. To further this end, the said
board are authorized to engage the services of a competent surveyor and
engineer, who shall have charge of and superintend such drainage and
improvements as shall be adopted. It shall be the duty of such surveyor
and engineer, on complaint of three or more citizens and taxpayers of the
county, to go over, examine and report to the board of County Commis-
sioners what, if any, drainage and other improvements are necessary for
the road complained of, together with an estimate of the cost of doing the
same, and if, in the judgment of said board, after receiving said report
and estimate, said drainage shall be necessary, the said board shall order
the said surveyor and engineer to proceed to lay off such ditch or ditches
as may be necessary, and outlets for the same to some creek or branch
which may be a natural drain with ascertained depth and width for the
complete and perfect drainage of the same; and to advertise and let out
