1904, ch. 401, sec. 61. 1914, chs. 423 and 594, sec. 61.

96. The male citizens living within the corporate limits of "The Com-
missioners of Leonardtown," above twenty-one years of age, who shall
have resided in the town for the space of four months, and twelve months,
in the State of Maryland next preceding the election, and shall be at the
time a citizen of the United States, together with residents of St. Mary's
County owning real estate within said corporation, and possessing all the
above prescribed qualifications, except residing in said town, shall elect
by ballot on the first Tuesday in May in the year 1914, two discreet persons
who shall have resided within the limits of said corporation for at least
twelve months next preceding the election, to succeed those whose terms
expire in the year 1914 as heretofore provided, and on the first Tuesday
in May, 1915, three discreet persons who shall have resided within the
limits of said corporation for at least twelve months next preceding the
election, to succeed those whose terms shall expire in 1915 as heretofore
provided; and on the same day in each year thereafter alternately two
and three discreet persons with the above qualifications to act as com-
missioners of said town. The election to be held at the Court House or
some other suitable and convenient place in the limits of said corporation,
to be designated by the Commissioners of Leonardtown.

97. All elections shall be held and conducted as shall be from time to
time directed by the by-laws of said corporation not inconsistent with the
provisions of this charter. The failure to hold an election, or if the citi-
zens of said town, at any time neglect to make an election at the time
before mentioned, the power of electing Commissioners shall not cease,
but the qualified voters in said corporation may hold an election according
to the by-laws of the "Commissioners of Leonardtown" at some suitable
and convenient place in said corporation for the: purpose of electing the
requisite number of Commissioners to serve for the balance of the regular
term, and in the event of no election for any reason whatsoever the Com-
missioners for the time being shall continue and remain in office until an
election be held and their successors qualify, with all the power and au-
thority incident thereto.

98. If any person elected as Commissioner shall refuse to serve as
such, or his place become vacant by death, insanity, resignation, disqualifi-
cation or otherwise, the remaining Commissioners may fill his place from
among the qualified voters of the town. Each Commissioner before he acts
as such shall make oath before some justice of the peace of St. Mary's
County that he will diligently and faithfully, and to the best of his skill,
perform his duties as Commissioner without favor, partiality or prejudice,
and the justice of the peace shall make out a certificate of such qualifica-
tion, and shall file the same with the Commissioners, to be recorded among
the records of the town.
