be imprisoned for a term not exceeding five years in the penitentiary,
or not exceeding three years in the house of correction or not more than
one year in jail.
UPPER MARLBORO.

986. The citizens of the town of Upper Marlboro, in Prince George's
county, are created a body corporate by the name of "The Commissioners
of Upper Marlboro," and by that name may have perpetual succession,
may sue and be sued, and may have and use a common seal.

987. The corporate limits of the town of Upper Marlboro shall be as
follows: Commencing at the mouth of the Federal Spring branch at its
confluence with the Westen Branch and running down with the meanders
of the Western Branch on the south side thereof, and exclusive of said
branch, to the stream beyond James B. Belt's meadow; then up and with
said stream to the small bridge culvert on the road from Upper Marlboro
to Rosaryville, back of the former residence of A. T. Brook; then in an air
or direct line across the land of Fredrick Sasser to the Federal Spring
branch at a point which will throw into the corporation all the land for-
merly purchased by Thomas E. Williams and C. G. Magruder, Jr., of the
trustees of D. Benedict J, Gardner; then down and with the meanders of
said Federal Spring branch on the south side thereof, and exclusive of said
branch to its mouth, the beginning point aforesaid.

988. The Commissioners of Upper Marlboro shall be three in number
and shall be elected on the first Monday in January, 1904, and on the
first Monday in January in every second year thereafter; and until the
first Monday in January, 1904, Fredrick Sasser, John H. Traband and
Solomon M. Sweeney, shall be and are hereby constituted commissioners
of the said town of Upper Marlboro; that any two of said commissioners
elected as aforesaid shall constitute a quorum for the transaction of
business. The said commissioners and all the officers of the said cor-
poration before entering upon the duties of their office, shall take an
oath, before a justice of the peace within the limits of said corpora-
tion, that they will diligently and faithfully to the best of their judgment
and ability, discharge the duties of their office without favor, partiality
or prejudice, and shall file the certificate of the officers before whom the
same is taken among the records of the corporation; and said commis-
sioners shall meet not more than one week after their election, and shall
select one of their number president, who shall preside at their meetings
and preserve order; they shall also select one of their number as treasurer
of said corporation to serve for two years and until his successor shall
qualify, whose duty it shall be to keep an account of the receipts and
disbursements of the funds of the corporation in a well bound book, to be
