verted or used in any other way than that in which the same is directed
to be used herein, the person or persons diverting said funds or suffering
said funds to be diverted shall be deemed guilty of a misdemeanor, and
on conviction thereof shall be subject to a fine of not less than One hun-
dred ($100) dollars, or imprisonment for a term of not less than six
months, or both fine and imprisonment in the discretion of the Court.
GARBAGE.
1929, ch. 138, sec. 1.
801. The Mayor and Common Council of Mount Rainier, a municipal
corporation, is hereby authorized and empowered to levy and collect an-
nually a special assessment of not to exceed twenty cents on each one
hundred dollars of the assessed valuation of all real and personal property
in the town, appearing on the books of the town treasurer; the money
derived from such special assessment to be used exclusively for the estab-
lishment and maintenance of a garbage and/or ash and/or trash collection
and disposal service within the corporate limits of said town, said garbage
and/or ash and/or trash collection and disposal service to be established
and maintained by said Mayor and Common Council of Mount Rainier,
Maryland, either as a municipal operation or by contract with such per-
son, firm or corporation as may be satisfactory to the said Mayor and
Comm on Council of Mount Rainier, and the said Mayor and Common
Council of Mount Rainier, Maryland, are hereby authorized and empow-
ered to pass such ordinances which they may deem necessary from time
to time in order to provide for the proper collection and disposal of said
garbage, ashes and trash and to prescribe such penalties for the violation
thereof as they may now prescribe for the violation of town ordinances
under the authority heretofore granted by Section 768 of this Article.

802. Said Mayor and Common Council of Mount Rainier are hereby
authorized and empowered to levy and collect the special assessment pro-
vided for in Section 801 hereof in the same manner provided in the
charter of the town of Mount Rainier for the collection of taxes in Mount
Rainier and amendments thereto.

803. The money realized from such special assessment shall be kept
by the Town Clerk and Treasurer of Mount Rainier in a special fund and
shall be used for no purposes other than that specified in this Act. Any
surplus arising from such assessment in any year shall be considered by
the Mayor and Common Council in making the levy for the succeeding
year and such surplus shall be used, together with the money realized from
the new levy, for the purposes set forth in" Section 801 of this Article.

804. The powers granted to the said Mayor and Common Council of
Mount Rainier by Section 801 hereof shall not become operative until a
