PRINCE GEORGE'S COUNTY. 3869

taxes levied by the said Commissioners are hereby declared to be a lien
upon all real estate in said town from the date of their levy until paid.

1929, ch. 342, sec. 15.

455. The County Commissioners of said Prince George's County shall,
and they are hereby directed to, return and pay over annually to the Com-
missioners of said town of Fairmount Heights three-fourths (3/4) of the
money collected on account of the county road tax from property within
the said town of Fairmount Heights in the same amount and manner as
is now required by law to be paid to incorporated towns in said county,
the money so returned to be expended by the said Commissioners of Fair-
mount Heights for improving, maintaining and repairing the roads,
streets, lanes and alleys in said town.

456. Said members of said Board of Commissioners of Fairmount
Heights, for the purpose of making contracts or otherwise incurring lia-
bilities in the performance of the duties provided by this Act, shall be
considered in law as a corporation, and are not to be held individually or
personally liable in connection therewith.

1929, ch. 342, sec. 17.

457. The Treasurer of said Commissioners of Fairmount Heights shall
deposit all funds coming into his hands as such, together with all interest
accruing thereon, in such depository or depositories as directed by a ma-
jority of the said Commissioners, to his credit as such Treasurer, and
that the Treasurer of said Commissioners shall not dispose of any of the
funds coming into his hands as such Treasurer, except upon check duly
signed by him as Treasurer, and countersigned by the chairman of said
Board of Commissioners, or some member thereof acting as chairman.
Such acting chairman shall be duly authorized to act by resolution of said
Board of Commissioners which must first be placed upon the minute
book of the Board of Commissioners.

1929, ch. 342, sec. 19.

458. In the event that this charter is adopted by the citizens of said
Fairmount Heights under the provisions of the referendum above set
forth, then the same committee who conducted the referendum election
with the same powers of filling vacancies thereon shall, on the first Tues-
day, August, 1929, hold another election for the five Commissioners pro-
vided for herein in the manner and form prescribed herein for general
elections, except that the said committee shall canvass the votes oast and
publicly announce the result thereof. The five persons having the largest
number of votes shall be declared by said committee as the first Board of
Commissioners for said Town of Fairmount Heights, and upon their
taking the oath herein prescribed shall become the Board of Commis-
sioners for said town.
