833. The council shall have power to open and keep open streets, lanes
and alleys, with the consent of the owners of the land through which the
same may pass, or upon paying damages therefor, to be assessed by three
disinterested persons to be appointed by the council, who shall, in making
such assessment, take into consideration as well the benefits that may
accrue to the owners of said property as the damages that may occur by
reason of said opening to said owners, which said persons shall report
their proceedings to the council, whose proceedings shall then be similar
to those of county commissioners of this State in such cases, with right
of appeal to the Circuit Court for the county. Whenever the opening,
grading, piking or paving of any street, or part of any street, shall be
done, the council shall, after due notice thereof given by them, award the
work to be done to the lowest responsible bidder therefor.

834. The parts of the several county roads within the limits of said
town are hereby made and declared to be public streets or avenues of said
town, and shall be from time to time improved and repaired as in the dis-
cretion of the council the public interest may require and the resources
of the town will justify.

835. The Mayor and council of Rockville is hereby constituted the
Water Board for Rockville, and as such water board they are authorized
and empowered to construct and erect water works for the said town, and
to contract for purchase in fee simple or lease for a term of years, renew-
able at their pleasure, any land, real estate, spring, brook and water course,
and to use and occupy forever or for a term of years any land, real estate,
spring, brook, or water course which they may deem expedient and neces-
sary for the purpose of furnishing said town with water; and they are
hereby vested with all the rights and powers necessary for the introduc-
tion of water into said town. If from any cause the said water board of
Rockville shall be unable to agree with any owner of real or leasehold
estate, spring, brook, water or water course or any other material which
partakes of or is part of realty, or for any right of way which they find
necessary for the conduits of said water in its entry into the said town,
or if such owner is under any disability or incapacity to contract, or absent,
or unknown, the said water board of Rockville is hereby clothed with the
power of condemnation under the right of eminent domain, as provilel
in Section 203 of Article 23 of the Code of Public General Laws of Mary-
land, as fully as if said section had been herein incorporated; and their
manner and procedure in condemnation for the purposes of this act shall
