LIVERY STABLE KEEPERS AND FARMERS.

582. It shall be lawful for any livery stable keeper or for any farmer,
who takes horses or other live stock at his stable, or on his farm, for the
purpose of livery or grazing, or wintering such stock in Montgomery
county, to retain in his custody, any horse, mare, gelding or other live
stock placed under his care for livery, grazing or wintering, as the case
may be, and also any vehicle in their respective charge, until all charges
for so keeping the same shall have been paid by the owner, or his agent;
find if such owner or agent shall, when using such horse, mare, gelding,
other live stock or vehicle, fail to return the same to such livery stable
keeper or farmer, with intent to evade the payment of any charges due
for the keep or care of such stock or vehicle, then it shall be lawful at any
time within thirty days from the date of such failure to return such prop-
erty, for such livery stable keeper or farmer to follow and seize such horse,
mare, gelding, other live stock or vehicle, and to sell the same, as pro-
vided in the next succeeding section of this article.

583. It shall be lawful for such livery stable keeper or farmer to sell
any such horse, mare, gelding, other live stock or vehicle at public auction
for cash in said county, after giving at least three weeks' public notice of
the time, place and terms of sale in one or more newspapers published in
said county prior to the date of sale, and after deducting the amount due
for the keep and care of such stock or vehicle, together with all expenses
attending such sale, to pay over the surplus, if any, to the owner.

584. Before proceeding to sell such horse, mare, gelding, other live
stock or vehicle, as hereinbefore provided, it shall be necessary for such
livery stable keeper or farmer to state an account for the keep and care
of such horse, mare, gelding, other live stock or vehicle, and prove the
same before a justice of the peace for Montgomery county, who, upon
being satisfied by proof of demand and refusal or neglect to pay said
account on the part of the owner thereof, shall issue his warrant author-
izing such sale as aforesaid; provided that the proprietor of such livery
stable or farmer shall set up upon his premises in some conspicuous place,
a copy of the foregoing two sections, printed in large type, and his rates
for livery or charges for grazing or wintering, as the case may be.
