1898, ch. 453, sec. 17. 1912, ch. 790, sec. 266.

436. Those parts of the several county roads within the limits of said
town are hereby made and declared to be public streets or avenues of said
town, and shall be from time to time improved and repaired, as in the
discretion of the council the public interest may require and the resources
of the town will justify.

437. The commissioners of the county, the Board of Public School
Commissioners, justices of the peace, sheriffs, constables and all other
State and county officers, shall have, hold and exercise their offices in
said town as heretofore, except as qualified by the other sections of this
Act. The County Commissioners of Montgomery County shall, on or
before the first day of January, eighteen hundred and ninety-nine, and
on or before the first day of January in each and every year thereafter,
pay over to the town of Garrett Park that proportion of the entire county
levy for the repair of roads which the total real property assessed within
the limits of the town of Garrett Park bears to the whole amount of
assessed property in Montgomery county, so that the town of Garrett
Park shall receive and disburse, for the maintenance of the streets of
said town the amount levied for the repair of roads by said County Com-
missioners of Montgomery County, upon the real property within the cor-
porate limits of the town of Garrett Park.

438. This subtitle of this article is hereby declared to be a public act,
and may be used in evidence in all the courts of this State without proof.

440. The Mayor and council of Garrett Park are hereby authorized
and empowered to borrow on the credit of the said town an amount not
exceeding fourteen thousand ($14,000) dollars, and to issue coupon bonds,
therefor under the corporate seal of the said town of Garrett Park, which
said bonds shall be signed by the Mayor and the clerk and treasurer of
said town, each of the said bonds to be of the sum of one hundred dollars.
($100) and to bear interest from the date of issue thereof at a rate of not
more than five and one-half per centum per annum, payable semi-annually,
and which said interest to the maturity of each bond shall be provided for

sons owning property within the limits of said town who may be absent there-
from, or a non-resident thereof, or upon whom, for any other reason, personal
service cannot be had, and the marshal shall make return to that effect, service
of notice or process made may be made by publication of said notice or process
once a week, for three consecutive weeks, in some newspaper published in Mont-
gomery County, which said notice by publication shall be as good and effectual as
personal service. The affidavits of the publisher or proprietor of said newspaper
as to such publication shall be evidence of the fact thereof.
