ceive the same fees allowed justices of the peace in similar cases; and an
appeal from his judgment, when the demand or fine exceeds five dollars,
may be taken to the Circuit Court for the county, which shall hear and
determine the matter as upon appeal from justices of the peace.

422. The town marshal and health officer shall attend the meetings of
the council, and perform such duties as shall be directed. The marshal
shall preserve the peace and good order of the town, and for this purpose
he is invested with the same power and authority as any constable under
the laws of the State.

423. The council and all other officers of the corporation shall, before
they enter upon the duties of their respective offices, take an oath that
they will faithfully and diligently discharge the duties of their office with-
out favor, partiality or prejudice, and said oath shall be filed among the
records of the corporation.

424. The clerk and treasurer shall give bond to the council in such
penalties and with such sureties as the council may require conditioned
for the faithful performance of the duties of his office.

425. The council shall receive all returns of election and determine all
questions arising thereunder; but any person considering himself ag-
grieved by such decision may appeal therefrom to the Circuit Court for
Montgomery County, which court shall hear and determine such appeal
and decide who shall pay the costs thereof.

426. The council is hereby authorized to prepare a plat of said town
upon which shall be shown all streets, roads and public ways, whether
heretofore laid out or projected, and by which all lots and property
therein shall thereafter be described; to control the sub-divisions of all
land and property within the corporate limits of said town; to establish
building lines and compel all persons erecting buildings in said town to
conform thereto. The council shall have the power, and it shall be their
duty to pass such ordinances as may be necessary, beneficial and proper,
and for the enforcement of the provisions of this charter not inconsistent
with the laws:
(1) To preserve the peace, good order and the best interests of the
town;
(2) To maintain its cleanliness and health, and to this end;
(a) They shall have the same powers as the State Board of Health of
this State within the corporate limits of said town, and one-fourth of a
mile outside thereof in every direction;
