38. The commissioners shall not expend or contract to expend in any
one year more money than the revenues for that year.

39. The commissioners for the county, justices of the peace, sheriff,
constable, and all State and county officers shall have, hold and exercise
their offices and jurisdiction in said town as if this charter had not been
granted; and the County Commissioners of Montgomery County shall, on
or before the first day of January, in the year 1905, and on or before the
first day of January in each and every year thereafter, pay over to the com-
missioners of said Town of Barnesville that proportion of the entire county
levy for the laying out and repairs of roads which are* the real property as-
sessed within the limits of the Town of Barnesville bears to the whole
amount of assessed property in Montgomery county, so that the commission-
ers of Barnesville may receive and disburse for the repair and maintenance
of the streets of said town the amount levied upon the real property within
the corporate limits of the Town of Barnesville for the construction and
repair of roads by the said Commissioners of Montgomery County.

BATTERY PARK.

40. The Board of County Commissioners of Montgomery County at
the time of the annual tax levy beginning- with the levy of the year 1927
are hereby authorized and empowered to make special annual levy of such
amount as may be necessary to produce annually the sum of One Thou-
sand Dollars ($1,000.00), on each $100.00 of the whole assessable prop-
erty, situate in the subdivision of Battery Park, Section One, as recorded
in Plat Book No. 1, plat 245 and in Battery Park, Section Two, as re-
corded in Plat Book No. 3, Plat No. 260, and in Battery Park, Section 3,
as recorded in Plat Book No. 3, Plat No. 261, all of said Plat Books
and Plats being a part of the land records of Montgomery County, Mary-
land, to be collected as other county taxes in said county are collected and
said special annual levy so collected shall be paid over by the said County
Commissioners to the Treasurer of the Battery Park Citizens' Association
to be used by said Association exclusively for the maintenance of the Bat-
tery Park Community House, provided that fifty per cent, or more of
the registered voters of Montgomery County, residing in said Battery Park
Section 1, Section 2 and Section 3, shall, thirty days prior to each annual
levy petition the said County Commissioners there by asking that such
special levy be made.
