sons whose claims are not paid in any one year by reason of the lack of
money to the credit of the said fund which is to be designated "The Dog
License Fund," shall be paid out of the first money coming into the fund
after his claim is reached, and shall be paid in the order in which said
claims are proved and filed; and any claims now filed and passed upon,
but remaining unpaid, shall have preference over any new claims in the
order of payment. Any fund in excess of one thousand dollars ($1,000)
remaining in the hands of the County Commissioners of Kent County,
after the payment of the claims as aforesaid, unused for such purpose at
the end of each fiscal year, shall be used by said County either for the
public schools, or for the public roads, as the Board of County Commis-
sioners of said County may direct.

165. When any inhabitant of Kent County shall have any sheep,
poultry or livestock destroyed or injured by a dog or dogs, he shall within
six hours have the carcass or injured animal viewed by three disinterested
persons, and they with the owner appear before the Board of County Com-
missioners and answer under oath such questions as pertain to the case;
and the Commissioners shall award for damages such amount as they may
deem fair; which award shall be paid out of the fund hereby created.

The damages awarded for turkeys shall not exceed $1.00 for turkeys
one month old, $2.00 for turkeys three months old, $3.00 for turkeys five
months old, $4.00 for turkeys seven months old, or over.

The damages awarded for lambs and sheep shall not exceed $1.00 for
lambs or sheep one month old, $3.00 for lambs or sheep two months old,
$5.00 for lambs or sheep three months old, $6.00 for lambs or sheep six
months old or over.

And if the owner of the dog or dogs doing the damage be known, it shall
be the duty of the County Commissioners to notify such owner or owners
to kill said dog or dogs immediately. If such dog or dogs be killed by the
owner, after notice as aforesaid, he shall be exempt from all further lia-
bility, but in case the said owner or owners should refuse or neglect to kill
said dog or dogs upon notice as aforesaid, the said owner or owners shall
be liable to the County Commissioners for said damages to the same extent
as he would be liable in case of negligence or malicious destruction of
property, and the said County Commissioners may in their discretion have
the Dog Constable to kill said dog or dogs.

166. Any person violating or refusing to comply with any of the pro-
visions of this Act shall be guilty of a misdemeanor, and upon conviction
thereof before any Justice of the Peace of Kent County, or in the Circuit
Court of Kent County, shall be fined a sum of not less than five dollars
($5.00) nor more than twenty-five dollars ($25.00) or shall be imprisoned
in the county jail for not more than thirty days, or shall be both fined and
imprisoned in the discretion of the Court. It shall be the duty of the
