HOWARD COUNTY. 3113

District Road Superintendents to work and take charge of and manage
the work on the public roads and bridges in the district for which he or
they are appointed, subject to the control and direction of the County
Road Superintendent, and he or they shall perform such other duties as
the said County Road Superintendent may prescribe. And the said

County Road Superintendent shall cause the District Superintendents to
perform their duties between the first day of April and the first day of
December in each and every year.

265. The County Commissioners of Howard county shall have con-
trol and supervision of purchasing all materials to be used in the build-
ing, construction and maintaining roads in Howard county; provided,
however, that the County Road Superintendent shall inspect such material
and recom mend to the County Commissioners whether it is adapted for the
purposes to be used.

266. Whenever any person or persons shall desire to improve any pub-
lic road in said county to any extent beyond that contemplated by the said
County Road Superintendent he or they may make application to the
County Commissioners by petition, setting forth the location of the road
to be improved, the extent and character of the improvement, and the
probable cost thereof, and the said County Commissioners shall thereupon
order the County Road Superintendent to examine the location and pur-
pose set forth in the petition; and if he shall be of the opinion that the
public interest will be promoted thereby, he shall report his determina-
tion to the County Commissioners, setting forth his reasons for such de-
termination and an estimate of the costs of such improvement; and if
the County Commissioners shall approve the report of the said County
Road Superintendent, they shall include in their next levy an additional
amount not to exceed fifty per cent. (50%) of the estimated total cost,
such levy, however, to be made only upon taxable property in the district

or districts wherein such public road lies; provided, further, that the
petitioners for such improvements shall first pay into the treasury of the
county an amount not less than one-half of said estimate; all of said
money to be expended under the direction of the County Road Super-
intendent.

267. It shall not be lawful for the County Commissioners to open
any new public road in Howard county until they shall have such proposed
road surveyed and platted by the County Road Superintendent and an

estimate in writing made by him of the cost of building such proposed
road, including necessary bridges on the same, and any such new public
Toads which the County Commissioners may hereafter decide to open shall
be built under control and direction of the County Road Superintendent,
