2890 ARTICLE 13.

overhead expenses and proper depreciation allowances, to make and charge
such service rates as it may deem necessary against all properties having
a connection with any sewer under their ownership. Said rates shall be
uniform throughout the town of Aberdeen, but subject to change from
time to time, as necessary."

57. The Commissioners of Aberdeen, for the purpose of projecting,
constructing and establishing a sewerage system, for the collection, trans-
mission and disposal of the house and other sewerage and drainage of
the town of Aberdeen, including either as a combined or separate feature-
of said system, the collection, transmission and disposal of storm and
ground water, respectively, are hereby clothed with all powers necessary
or proper for such purposes, or either of them, among which shall be the
following, that is to say:

1. To make all such preliminary investigation and to do all such
preliminary work as should in their judgment precede the actual pro-
jection, construction and establishment of such system of sewerage;

2. To construct, establish or acquire such local, district, lateral, inter-
cepting, outfall or other sewers, and all such conduits, drains and piping
or other plants, and all such buildings, structures, works, apparatus or
agencies, and to lay all such mains and pipes, and to create or use, or
create and use, all such instrumentalities and means as they may deem
expedient for carrying said system of sewerage so projected and adopted
as aforesaid into full effect;

3. To incorporate with said system of sewerage or otherwise utilize
for the purpose of this Act, so far as they may deem expedient, any or all
existing public sewers or drains, including storm water sewers or drains,
in the town of Aberdeen, and any or all of their apparatus, either in their-
present condition or with such repairs, modifications or changes as said
Commissioners may see fit to make, and to condemn, close up, abolish or
destroy in their discretion any or all such existing public sewers and
drains, or to alter their functions, or to increase their burdens, as they
may think best.

58. The Commissioners of Aberdeen may acquire, by gift, purchase,
lease, or by other methods of acquisition, or by condemnation, any land
or property, including any drain, sewer, water course or stream of water,
situated wholly or partly within or without the town of Aberdeen, or any
interest, franchise, easement, right or privilege therein which may be
required for the purpose of constructing and establishing said sewerage
system; and when and so often as resort shall be had to condemnation
proceedings, the procedure shall be that provided by Chapter* 33-A of the
Code of Public General Laws of Maryland (Bagby) regulating the pro-
cedure for the acquisition of property for public use by condemnation.
