2804 ARTICLE 12.

1914, ch. 34, sec. 29.

310. Any person who shall fraudulently procure a license as a hotel
keeper, without having complied in good faith with the provisions of this
Act, denning hotel keepers, shall, upon indictment and conviction thereof,
be fined not less than two hundred dollars, nor more than five hundred
dollars; the license granted shall be suppressed by the Court, and it shall
be unlawful for the Clerk to issue any other license for the sale of spirit-
uous or fermented liquors to such persons.

311. All prosecution for violation of any of the provisions of this Act
shall be upon presentment and indictment, and it shall be the duty of
any Justice of the Peace of Garrett County upon information received
and confirmed by the oath of a creditable witness to have any person
arrested and committed to the County jail for a violation of the provi-
sions of this Act, unless such person shall give sufficient bail or recogniz-
ance with sureties to appear before the Circuit Court for Garrett County
at the next succeeding term thereof to answer the charge.

312. No license shall be granted under the provisions of this Act to
any person other than a bona fide citizen of Garrett County, and who
shall have been such for at least one year prior to the date of his applica-
tion, and no license shall be granted to any applicant to sell spirituous
or fermented liquors anywhere in Garrett County except within the cor-
porate limits of the incorporated towns in said County.

313. Nothing in this Act shall give permission for the granting of a
license by any authority for the sale or barter in any way of spirituous,
fermented or malt liquors, or intoxicating drinks of any kind, or cider,
or tonic beer, lager beer, schnapps or gin, or any article used or sold as
a beverage in the composition of which whiskey, brandy, high wines or
alcohol or any spirituous or fermented liquors shall be an ingredient, on
the grounds of the Mountain Lake Park Association or within one mile
thereof, contrary to the provisions of Section 6 of the Act of 1882, enti-
tled "An Act to grant additional powers to Mountain Lake Park Asso-
ciation of Garrett County," a corporation incorporated under the General
Laws of Maryland.

1922, ch. 503, sec. 32A.

314. Whenever any person who is guilty of manufacturing, selling,
bartering, giving away, exchanging, carrying, bringing into, transferring,
handling, delivering or distributing intoxicating liquor in Garrett County
in violation of this Act, shall employ or use in such violation any horse
or other beast of burden, wagon, carriage, cart, truck, automobile, motor-
cycle or any other vehicle, in addition to the penalties herein provided,
