2780 ARTICLE 12.

1906, ch. 285, set. 138F. 1922, ch. 86, sec. 138F.

251. Every Mayor and Councilman before he or she proceeds to act
as such shall take oath before some Justice of the Peace for Garrett Coun-
ty that he or she will diligently and faithfully, according to the best of
his or her skill and judgment, perform the duties of Mayor and Council-
man, as the case may be, without favor, partiality or prejudice; and a

certificate of such qualification shall be returned by the said Justice of
the Peace to the said Council, to be filed and recorded among their pro-

ceedings.

1906, ch. 285, sec. 138G.

252. The said Council shall meet at such place as they may appoint,
within said term, on the first Monday of every month ensuing their elec-
tion, and as much oftener by adjournment as they may deem necessary;
that the said Council shall elect a president of the Council and appoint
a clerk, a bailiff, a treasurer, an attorney, a tax collector, and one or
more assessors of taxes, and fix their salary for compensation. All the
officers appointed by said Council shall hold their respective office for one
year from the date of their appointment or until their successors are
Appointed and qualified.

253. The clerk before entering upon his duties shall take the oath
herein prescribed for the members of the Council; he shall countersign
all orders for the payment of money, and keep a full and accurate set
of accounts of the town records and papers; he shall keep a journal of
the proceedings of the Council, which shall be open at all times for the
inspection of any citizen.

1906, ch. 285, sec. 138-I.

254. The treasurer before he enters upon his duties shall take the oath
prescribed for members of the Council, and execute a bond of such con-
dition and in such amount as may be prescribed by the ordinances of the
corporation, with security to be approved by the said Council; he shall
have the custody of all corporation funds, shall keep a full and accurate
set of accounts of the said town in a well-bound book for the purpose, and
shall pay out the funds of said corporation only upon orders of the Coun-
cil, signed by the Mayor and countersigned by the clerk.

255. The bailiff shall before entering upon his duties take the same
oath as the members of the Council, and shall perform the police duties
of the town, and is clothed with the same power as a constable, under
the general laws of the State of Maryland; he shall promptly bring all
violators of the ordinances of the town, and shall enforce the ordinances
of the town, and shall receive the same fees as a constable in Garrett
county for making arrests, or serving any process for violation of the
ordinances of the town, or in the discharge of his duties as bailiff.
