2778 ARTICLE 12.

1924, ch. 29.

245. Whenever any party to any cause pending before any justice of
the peace of this county or the counsel of such party shall make a sug-
gestion in writing supported by the affidavit of such party or his counsel,
or other proper evidence, that the party cannot have a fair or impartial
trial by the justice of the peace before whom the suit, action, issue or
petition is pending, the said justice of the peace shall order and direct the
record of proceedings in the said suit, action, issue or petition to be trans-
mitted for trial to another justice of the peace of the same election dis-
trict in which the cause is first instituted, if there be another such jus-
tice of the peace, and if there be no other such justice of the peace in
said election district, then the said record shall be sent to the justice of
the peace of an election district adjoining the election district in which
the cause is so first instituted.

KITZMILLERSVILLE. *

1906, ch. 285, sec. 138A.

246. That the inhabitants of the town of Kitzmillersville, in District
No. 13, in Garrett county, State of Maryland, are hereby incorporated
by the name of the "Mayor and Council of Kitzmillersville," that by that
name they have perpetual succession, may sue and be sued, and may have
and use a common seal, and may purchase and hold such real, personal
and mixed property, as may be required for the purposes of said corpo-
ration, and may dispose of such property, when necessary, for the benefit
of said corporation; and all the property and funds of every kind belong-
ing to said corporation are vested in the Mayor and Council of Kitzmil-
lersville.

247. The corporate limits of the town of Kitzmillersville are hereby
declared to be as follows: Beginning at a planted stone standing on the
north bank of the north branch of the Potomac River, and running thence
south 57 .degrees west 1750 feet to a planted stone; thence south 75 de-
grees west 700 feet to a planted stone; thence south 27 degrees and 30
minutes west 1162 feet to the north bank of the said river; thence down
and with the north bank of the said river, south 30 degrees east 455 feet;
thence south 42 degrees and 30 minutes east 253 feet; thence south 62
degrees and 15 minutes east 103 feet; thence south 66 degrees and 30
minutes east 423 feet; thence south 85 degrees and 15 minutes east 353
feet to Third Avenue in said town of Kitzmillersville; thence south 86
degrees east 267 feet; thence north 84 degrees and 30 minutes east 377
feet to Second Avenue in said town of Kitzmillersville; thence north 64

*Kitzmillersville has been authorized to issue bonds and to levy taxes to pay
interest on and to redeem said bonds, as follows: 1922, ch. 378, $15,000 for street
improvements; 1927, ch. 208, $5,000 for river wall. Both of these Acts were ap-
proved by the voters.
