FREDERICK COUNTY. 2635

P. L. L., 1888, Art. 11, sec. 419. 1918 Code, sec. 667.

689. The said Baltimore and Ohio Railroad Company shall be liable
to pay a fine of one hundred dollars for each day that said company
shall neglect or fail to comply with the provisions of the preceding sec-
tion; one-half of said fine to go to the use of the informer and the other
half to the use of the school commissioners of Frederick County, to be
recovered in an action of debt in the name of the State of Maryland, be-
fore any justice of the peace for said Frederick County.

1900, ch. 397, sec. 1. 1918 Code, sec. 668.

690. The Baltimore and Ohio Railroad Company is required to keep
a flagman stationed during every hour of the twenty-four of each and
every day in each and every year at the crossing of said railroad over
the county road at the station of Monrovia, Frederick County, to warn
persons of approaching of trains; provided, that the county commission-
ers of Frederick County shall deem such flagman necessary for the proper
protection of life and property at said crossing.

691. The said Baltimore and Ohio Railroad Company shall be liable
to pay a fine of fifty dollars for each and every day that said company
shall fail to comply with the provisions of the preceding section after
the fifteenth day of April, in the year 1900; said fine to be recovered in
an action of debt in the name of the State of Maryland before any justice
of the peace in and for Frederick County; said fine to be paid when
collected in to the public school fund of Frederick County.

692. The Baltimore and Ohio Railroad Company is required to place a
watchman or flagman at the crossing, one-fourth of a mile below the sta-
tion at Doubs, Frederick County, Maryland, to supersede the bell now
employed at that place, by the said company, to warn all those who may
have occasion to use said crossing of the approach of trains; said watch-
man or flagman to guard the said crossing during each and every day
from 6 o'clock A. M. to 9 o'clock P. M.

693. If the said Baltimore and Ohio Railroad Company shall fail,
neglect or refuse to comply with the provisions of the preceding section
it shall be compelled to pay the sum of fifty dollars for each and every
of such failure, neglect or refusal, to be collected at the suit of any person
aggrieved thereby; one-half of the said sum to be paid to the plaintiff in
said suit, the other half to the board of school commissioners of Frederick
County, Maryland.
