P. L. L., 1888, Art. 11, sec. 243. 1918 Code, sec. 291. 1927, ch. 190.

270. Before the Mayor and Aldermen of Frederick shall pass any
ordinance under the preceding section ten days' notice shall be given of
a,ny application for the passage of such ordinance in one of the news-
papers published in said city; and before any commissioners appointed
by any ordinance of said corporation under this and the preceding sec-
tion, shall proceed to the performance of their duty, they shall give ten
days' notice in at least one of the newspapers published in said city, of
the object of the ordinance under which they propose to act before the
time of their first meeting to execute the same.

271. The Mayor and Aldermen of Frederick shall have full power and

authority to grade and pave all sidewalks and footways, and set all curbs
and gutters, prescribe the material to be used in the construction thereof,
and to charge the whole or any portion of the cost to the abutting owners;
and compel owners of the abutting property, within the limits of the cor-
poration, to grade and pave sidewalks and footways, with such material
as it shall think proper, and from time to time alter and change the grade;
and in case the owner or owners of the abutting property shall refuse to
pave such sidewalks or footways, when directed so to do, the corporation
shall have the work done at the expense of the city, and shall direct the
City Engineer to ascertain the proportion of expense chargeable to each
proprietor, and it may recover the same by action in the Circuit Court
for Frederick County, or before a justice of the peace, according to the
amount awarded, or may distrain the property, real or personal, of such
proprietor or proprietors; provided, at least ten days' notice be given by
the Mayor of the amount of any such assessment, prior to such suit or
distress; and said Corporation may provide for the assessment and col-
lection of all assessments for constructing curbs and gutters, by ordinance,
and all such assessments shall be liens on the abutting property; whether
they be assessments for the construction of footways and sidewalks or for
curbs and gutters, until paid; and said corporation is vested with full
power to pass all ordinances necessary to carry this section into effect,
and all ordinances or parts of ordinances heretofore adopted by the Mayor
and Aldermen of Frederick, now in force, and not in conflict with the
provisions of this section are continued in force, until the same are re-
pealed or modified.

272. The Mayor and Aldermen of Frederick is hereby authorized
and empowered, whenever in their judgment the public interests or con-
venience require it, to provide by ordinance for the grading, paving, curb-
ing and sewering, or for the grading, or paving, or curbing, or sewering,
and for the regrading, repaving, curbing and sewering, or for the regrad-
