2458 ARTICLE 11.

of the corporation, the commissioners, or a majority of them, for the
time being, shall elect a burgess or commissioner to fill the vacancy for
the remainder of the term, and until a successor shall be elected and quali-
fied, and during the temporary absence from town of the burgess, or his
illness, and until the burgess is again able to act, the president of the
Board of Commissioners shall be the acting burgess, with all rights, pow-
ers and duties of said burgess, excepting the powers of appointment and
removal.

158. The burgess and commissioners elected shall within ten days
after notice of their election qualify by taking and subscribing the oath
prescribed by the Constitution before a justice of the peace of the State
of Maryland in and for Frederick County, who shall certify to the same
and return a certificate thereof to the clerk of the Circuit Court for Fred-
erick County, to be recorded in the test book kept in his office, and shall
each receive such compensation as said officers as shall be fixed by ordi-
nance, but neither the burgess or any commissioner shall have his com-
pensation or salary increased or diminished during his term of office.

159. The commissioners may appoir.t their own clerk, prescribe his
duties and allow him such compensation as they may think proper.

160. The clerk shall enter all ordinances passed by the commissioners
in a book to be kept for that purpose, which shall be properly and con-
veniently indexed and shall be open at all times to the inspection of any
citizen or taxpayer for any proper purpose; and when the burgess shall
fail to act on any order, resolution or ordinance within ten days after the
date of its passage, he shall endorse the fact thereof upon each order, reso-
lution or ordinance on which he shall thus fail to act.

161. The commissioners shall meet on the business of the town in pub-
lic session on the second Tuesday of each month at such place as shall be
fixed by ordinance from 8 P. M. to 9 P. M., and at such other times as
they may deem necessary, and may compel the attendance of absent mem-
bers in such manner and under such penalties as they may by ordinance
provide.

162. The commissioners shall have power-by a majority vote of the
members of the board, with the written approval of the burgess, or over
his veto, as provided in Section 173 of this subtitle, to make, alter and
repeal orders or resolutions not inconsistent with law or the provisions of
this subtitle; to enact, alter or repeal ordinances to be called the "Ordi-
