not less than $200, or be imprisoned in the county jail or House of Cor-
rection for not less than ninety days, or both fine and imprisonment, in
the discretion of the court, and shall make good the loss arising from such
neglect of duty or fraud.

459. It shall be the duty of the County Commissioners of Dorchester
County whenever the office of County Road Engineer shall become vacant
by death, resignation or removal from office, within sixty days from the
date of such vacancy to appoint some person to fill the same, and in the
same manner and with the same qualifications as prescribed by Section
453 of this Article.

460. The County Road Engineer appointed under the provisions of
this Act shall give bond to said County Commissioners, properly con-
ditioned for the faithful performance of his duties, in the penalty of one
thousand dollars.

461. Whenever any person shall desire the improvement of any public
road or portion thereof in said county to an extent beyond that decided
upon by the County Commissioners and the County Road Engineer, they
may make application to the said County Commissioners by petition
definitely stating the location of the road or portion thereof, the character
of the improvements desired and its probable cost; and the County Com-
missioners shall thereupon order the County Road Engineer to examine
the location and purposes set forth in the petition, and if he shaJl be of
the opinion that the public interests will be promoted by compliance with
said petition, he shall so report to the County Commissioners, with an
estimate of the money required and his reasons for such determination,
of the County Commissioners shall approve the report of the County Road
Engineer, they shall direct the expenditure to be made out of the road
levy or other moneys belonging to the county, and set aside for roads and
bridges; provided, that the petitioners for such improvements shall first
pay into the treasury of the county an amount equal to one-half of said
estimate; and all of said money shall be expended under the direction of
the County Road Engineer.

462. It shall not be lawful for the County Commissioners of Dorches-
ter County to open any new road in said county until they shall have
had such proposed roads surveyed and platted by the county road engi-
neer, and an estimate in writing made by him of the cost of building such
proposed new road, including necessary bridges in the same, and any
such new public roads which the County Commissioners may hereafter
decide to open shall be built under the control and direction of the county
road engineer, and shall not be accepted or paid for by the County Com-
