2322 ARTICLE 10.

owner in whole or in part by residents of such county the six preceding
months, if it is six months old; and the said master of said boat shall
also make oath before said clerk that he has been a resident of said
county for twelve months next preceding the time of taking said oath,
and that he will comply with all laws, general or local, regiilating the
catching of oysters, and that the time of taking such oath he shall exhibit
to the clerk the custom house license if five tons gross or over, and also
the certificate of the measurers of all boats whose gross tonnage, by the
rules of custom house measurement, are as shown by said custom house
license to be in excess of six tons gross measurement; and such licensee
shall carry such license at all times when working in his occupation and
produce the same when it shall be demanded by any duly authorized
officer.

416. All owners and masters of boats licensed under the two preceding
sections are constituted officers of the county, and clothed with authority
to arrest any and all violators of said sections, and to take such violators
before any judge or justice of the peace, to be dealt with according to
law; and for the purpose of making such arrests, are clothed with the
power to summon a posse comitatus to their aid.

417. Upon information given upon oath to any justice of the peace
of either of said counties, of any violation of Section 414, the said justice
of the peace shall issue his warrant for the arrest of the offender, and the
seizure of the boat and furniture on board, which warrant shall be
directed to the sheriff or any constable of the county, or any officer created
such by the preceding section, or to any officer of the State fishery force.

418. All money arising from fines and forfeitures imposed by the
provisions of this subtitle of this Article in so far as said provisions re-
late to the taking or catching of oysters in the waters in common between
Dorchester and Talbot Comities, shall be paid to the sheriff or any con-
stable of said counties respectively, and by him or them be paid monthly
to the County Commissioners, and said County Commissioners are au-
thorized to use such money, together with the sums received for said
licenses, which sums the clerks of said courts are directed to pay over
monthly to the County Commissioners of their respective counties after
deducting therefrom his usual fees for issuing license and in providing
police officers for the proper enforcement of the provisions of this sub-
title of these respective Articles; and in case any surplus remains at the
end of the fiscal year of the said counties it shall be placed to the credit
of the school fund of the county wherein such fines and forfeitures were
imposed.
