2312 ARTICLE 10.

proceed to give the notice and make the sale upon the same terms and in
the same manner as provided in the preceding section, and the owner shall
have the return of said stock on the conditions provided in that section;
and for making a sale under this section, the constable shall be allowed the
same commissions now allowed by law for the sale of personal property
under execution; this provision for commissions not to apply to sales of
stock taken up by the constable himself.

383. The said constable shall, out of the monies arising from such sale,
first pay the person taking up the stock, and the costs, charges and ex-
penses incurred, and damages sustained by the person upon whose land
said stock was trespassing, said damages, to be ascertained upon the oath
of two disinterested sworn appraisers, s.nd the balance, if any, to the own-
er of such stock; and should no one claim said balance as owner within
sixty days after said sale, the constable shall pay the same to the treasurer
of the school fund of the county, for the benefit of the public schools of
said county.

384. It shall not be lawful for any swine to go, run or roam at large,
and without an attendant or person in charge thereof, within the limits or
bounds of Election District No. 5, or Lakes, in Dorchester County, State
of Maryland.

385. It shall be lawful for any person, and it shall be the duty of any
constable of said district, to take up and impound any swine which may
be found going, running or roaming at large, and without an attendant or
person in charge thereof, within the limits and bounds of said district, and
the constable or other person so taking up and impounding any such swine
shall forthwith, and within twenty-four hours after so taking up and im-
pounding said swine, notify a justice of the peace, resident within the
limits and bounds of said district, which said justice of the peace shall,
upon being so notified as aforesaid, within twenty-four hours after being
so notified, give notice of said impounding by written or printed advertise-
ments or notices stuck up in at least three public places in said district,
one of which shall be in the vicinity of the place where said swine is im-
pounded, which said advertisements or notices shall contain a description
of the swine so impounded, and of the place where impounded, and shall
warn all persons that the same will be Hold at public auction, to the high-
est bidder, at the time and place set forth in said advertisements or notices,
which place of sale must be within the limits and bounds of said district,
and the day of sale not less than ten clays, nor more than fifteen days, from
the day on which the said swine was so impounded; provided, that if the
owner of any swine impounded under the provisions of this Act shall
prove to the satisfaction of the justice of the peace before whom the said
