after be passed by them, and for the printing of such codification thereof,
and the printed copy thereof, issued by the authority and under the sanc-
tion of the said Commissioners, shall be legal evidence of the passage of
said ordinances and the contents thereof in any court of law or equity
in this State.
DUTIES OF POLICE.

82. The chief bailiff, the sub-bailiffs and the policemen of the town,
as peace officers thereof, shall well and. faithfully perform the duties im-
posed on them by law and by ordinance, and by the rules and regulations
made by the Commissioners for their government and guidance in per-
forming their work and duty. But as peace officers they are required to
use care, prudence, judgment and good sense, so that they may not sub-
ject individuals, without sufficient cause, to arrest and imprisonment, or
the public to the cost and expense of needless criminal prosecutions; and
it shall be the duty of the Commissioners, in passing rules and regulations
for the government and guidance of the peace officers of the town to give
instructions to secure the observance of this provision. It shall be the
duty of the chief bailiff, the sub-bailiffs and the police force, as peace
officers, to maintain and preserve peace, good order and good conduct
within the limits of said town, and in all parts thereof, and among all
persons found therein. They shall repress, prevent and put down dis-
orderly conduct to the disturbance of the public peace, breaches of the
peace, gambling of all kinds, the unlawful sale of intoxicating drinks,
and any and all other unlawful and criminous acts and conduct whatso-
ever within the corporate limits of said town. Upon the application of
the chief bailiff and sub-bailiff, or any policeman thereof, for a warrant
of arrest, and upon the information on oath of such officer or any other
person who appears with or at the direction of said officer to lay the infor-
mation, the justice of the peace having jurisdiction and authorized to
issue such warrants, shall issue the same, directed to said officer, com-
manding him to make the arrest of the person named in the information,
and said officer shall execute and return said warrant or writ, but he shall
serve no other process in the case, except the warrant of arrest. The
fines imposed in any case on the trial and conviction of a defendant, for
an offense committed within the limits of the said town, -wherein the orig-
inal warrant or writ for the arrest of the same was directed to any of the
peace officers of said town, shall be paid to the Commissioners, less any
part thereof appropriated by the law to an informer, or for providing a
library or any charitable object.
If between 8 o'clock P. M. on one day and sunrise on the next day,
or at any time on Sunday, the chief bailiff and sub-bailiffs, or any police-
man of said town, has occasion to arrest any person for an offense com-
mitted therein, whether the offense was committed in the presence of the
officer or otherwise, and the officer believes that under the circumstances of
