on said President and Commissioners in Section 298 of this subtitle; pro-
vided, that no such fine shall exceed the sum of twenty-five dollars for each
violation of said ordinances or orders; when it may be practicable, it
shall be the duty of said President and Commissioners to do new and gen-
eral repair work by contracts made after public advertisement for proposals
from the lowest responsible bidder.

303. Said President and Commissioners shall have power and author-
ity, if in their judgment the protection of life and property demand it, to
pass all proper and necessary ordinances to require any railroad company,
or corporation, running its locomotives, engines or trains across any of the
streets within the corporate limits of the town to keep a watchman or flag-
man at the said crossings of the said streets to warn persons of the approach
of said locomotives, engines or trains, and the President and Commissioners
shall have full power and authority to impose such fines and penalties as
they may deem proper or necessary to carry out and enforce the powers
given by this section; provided, no such fine or penalty shall exceed the sum
of fifty dollars for each violation of said ordinances by such railroad com-
pany or corporation; and such fine or penalty shall be recovered by suit in
the name of the corporation before a justice of the peace in and for Cecil
County, as other small debts are recovered.

304. They shall have power to provide for the payment of damages and
expenses of opening, widening, straightening, laying out, paving, curbing,
rearranging and grading of sidewalks and streets in the town by levying
and assessing the same generally upon the whole of the assessable property
of the town, or specially upon the assessable property of persons benefited
thereby or along, or by whose property the same may be done and in the
event of said damages or expenses being levied or assessed specifically as
aforesaid, the President and Commissioners shall have full power and
authority to pass regulations and ordinances governing the said specified
levy and assessment, and the collection of the said damages and expenses
so specifically levied and amended.

305. If in opening or laying out any new street, lane or alley, the Com-
missioners cannot agree with the owners of any land or property wanted
for the purpose, for the purchase, use or occupation of the same, or if the
owner thereof be a femme covert, under age, non compos mentis, or out
of the county, application may be made to any justice of the peace of
the county, who shall thereupon issue his warrant, under his hand and
seal, directed to the sheriff of the county, requiring him to summon a jury
of twenty inhabitants of the county, not related to the parties nor in any-
wise interested, to meet on the land to bo valued, on a day to be named
