CARROLL COUNTY. 1779

plaint made before him of the violation of any ordinance of said corpora-
tion, shall issue process in the name of the said Maryor and Common
Council, to recover the fine or penalty imposed for the violation of such
ordinance against the person so offending, and said justice of the peace
may hear and determine the matter as any case airising under the laws
of this State can be heard and determined, and shall receive the same
fees therefor; said process may be issued to any constable of said county
or the bailiff of said town, returnable before said justice; and if issued
to said bailiff to be served, he shall have in such cases all the powers of a
constable to serve summons and execute commitment and receive the same
fees.

184. The said justice of the peace, in default of payment of any fine
or penalty imposed by him for the violation of any ordinance of the said
corporation, may commit the party so convicted and fined, to the lockup
or place of confinement in said town provided by said corporation, or to
the county jail at Westminster, in said county, as the case may be, for a
period not exceeding ten days; and the sheriff of Carroll County shall
receive and confine the party so committed in the same manner as other
prisoners are kept by him, and shall be entitled to the same compensation
therefor.

185. The Mayor may remit any fine or penalty imposed under any
ordinance of the Mayor and Common Council.

186. Any person living within the said corporation, who is not pos-
sessed of real estate shall pay a tax on his personal property, at the same
rate per centum as paid on real estate, which tax shall be used by said
municipal corporation in the same way as that collected on said real
estate; and the same assessors appointed by the said Mayor and Common
Council to assess real estate shall also assess the personal property owned
by persons not possessed of real estate within the said corporation.

187. All of the said taxes shall become due on the first day of Janu-
ary of each year, and if not paid when due, interest shall be charged until
paid.

188. The assessors appointed shall be empowered to administer oath
to property holders, both real and personal, in the said corporation, whilst
in discharge of their duty.
