1654 ARTICLE 6.

the remaining Commissioners, or a majority of them, shall elect a proper
person to fill said vacancy.

1929, ch. 38, sec. 10.

394. Every Commissioner, before he proceeds to act as such, shall
make oath before some justice of the peace for Caroline County that he
will diligently and faithfully, according to the best of his skill and judg-
ment, perform the duties of Commissioner without favor, partiality or
prejudice, and a certificate of such qualification shall be returned by the
said justice of the peace to the Commissioners, to be filed and recorded
among their proceedings.

395. The said Commissioners shall meet at such place as they may

appoint within said town on the second Monday of every month ensuing
their election, and as much oftener by adjournment as they shall deem
necessary.

396. The said Commissioners shall elect a president of their board,
and annually appoint a clerk, a chief bailiff and such number of under
bailiffs as they may, at any time, deem necessary to properly preserve
the peace, a treasurer and one or more assessors of taxes, whoso duties

and qualifications shall be as hereinafter prescribed.

397. The president of said Board of Commissioners shall preside at

all meetings of the Commissioners, unless prevented by sickness or rea-

sonable cause, in which event the said Commissioners may select a presi-
dent pro tempore; he shall sign all by-laws and ordinances of said Board

of Commissioners, and shall countersign all orders and drafts drawn by
the clerk, and under the direction of the said Commissioners, on the treas-
urer of said town.

398. The clerk shall be appointed from the citizens of said town,
qualified to vote for Commissioners; he shall, before entering on his duties,
make oath before the said Commissioners, or any one of them, that he
will well and faithfully perform the duties of his office as prescribed by
this Act, or which may be prescribed by any by-law or ordinance of said
Commissioners, to the best of his skill and judgment; he shall sign all

drafts or orders for money appropriated or ordered by the Commissioners
to be paid by the treasurer, and keep a record of the proceedings of said
Commissioners in a book to be provided by them for that purpose, which

shall at all times be open to the inspection of any person interested.

399. The bailiff shall be appointed from the inhabitants of said town
and qualified to vote for Commissioners; provided, however, that the said
