138 ARTICLE 1.

1927, ch. 554, sec. 2.

382. In addition to the license fees now imposed in Allegany County
under general or local laws against the person, firm, or corporation set
forth in section 381, before said person, firm, or corporation mentioned
in the preceding section and the limitations therein contained shall own,
operate, or maintain any of said chain stores in Allegany County they
shall first obtain from the Clerk of the Circuit Court for Allegany County
a special license to be known as a chain store license and pay to said
Clerk of the Court for each and every chain store operated or to be oper-
ated by said individual, firm, or corporation, the sum of five hundred
($500.00) dollars per year, which said license shall be payable to and
collected by the Clerk of the Circuit Court for Allegany County for the
use of the County Commissioners of Allegany County in the same manner
and form as traders' licenses are now issued, collected and payable. Any
person, firm, association, or corporation owning and operating said chain
store or stores in Allegany County, Maryland, after June 1, 1927, who
fails to take out said license on June 1, 1927, shall be deemed guilty of a
misdemeanor and upon conviction thereof by the Circuit Court for Alle-
gany County shall in addition to said license fee herein stipulated to be
paid be fined not less than five hundred ($500.00) dollars for each and
every offense, said fine to be paid to the County Commissioners of Alle-
gany County for the use of the public school system of Allegany County.

383. If any part or parts of this Act or if any section thereof shall be
held to be unconstitutional such unconstitutionality shall not affect the
remaining part or parts of this Act or any Section thereof. The Legis-
lature hereby declares that it would have passed the remaining parts of
this Act or any section thereof if it had known that such part or parts
thereof or any section thereof, would be declared unconstitutional

384. The clerk of any court, counsel or board in Allegany County
authorized to transfer any license shall, upon payment of one dollar, to be
used as the fee for such license issued, record any power of attorney to
transfer such license, and such license may be transferred thereafter only
on application of the grantee of such power.

LONACONING.*

1890, ch. 132, sec. 1.

385. The citizens of the town of Lonaconing, in Allegany County, are
a body corporate by the name of the Mayor and Councilmen of Lona-
coning, and by that name to sue and be sued and have and use a common
seal.

*Lonaconing was authorized to issue improvement bonds to extent of $25,000 by
ch. 174, 1924.
