1138 ARTICLE 4.

Court, in the discharge of their duties as such Police Justices and Jus-
tices of the Peace of the People's Court, respectively, and shall have the
right to punish any breach of order or decorum committed in their pres-
ence by a fine not exceeding $10.00, to be collected as other fines are
collected, and in default of the payment of said fine imposed by the said
several Justices of the Peace assigned to the station-houses in Baltimore
City or by a Justice of the Peace of the People's Court, the said Justice
shall have the power to commit the person on whom said fine is imposed
to the Baltimore City Jail for a period not exceeding one day for each
one dollar of fine so imposed. Provided, that in all cases where fine is
imposed under this section the party on whom the said fine is imposed,
if he feels aggrieved thereby, may within three days (exclusive of the
date of the imposition of said fine) appeal to the Criminal Court of Bal-
timore from the action of the said Police Justice or Justices of the Peace
of the People's Court in such case; and pending the hearing of said appeal,
shall give surety for his appearance in the Criminal Court of Baltimore
in a sum to be fixed by the said Justice, which sum shall not be in excess
of twice the amount of said fine imposed; and the person on whom such
fine is imposed under this section, shall at his option, instead of furnish-
ing surety for his appearance, have the right pending his appeal, to de-
posit with the Justice a sum in cash double the amount of the fine im-
posed, as collateral security for his appearance in the Criminal Court of
Baltimore on said appeal. Provided, no appeal shall be allowed under
this section after payment of the fine, but deposit of cash, as such col-
lateral security in double the amount of the fine shall not be construed
to be a payment of the said fine.

633. In all criminal prosecutions or proceedings which, under the
provisions of Section 632 may be heard, tried and determined before
a Justice of the Peace sitting at a station-house in the City of Balti-
more, it shall be the duty of such Justice of the Peace before whom such
case is tried, in the event of the conviction of the accused at the said trial,
to impose upon the said accused so convicted, the fine, or the fine and
punishment prescribed in case of such conviction by the Act of Assembly
of this State, or by the ordinance of the Mayor and City Council of Balti-
more, for the violation of which the accused was so tried. Any person
sentenced to the payment of any fine, and to the payment of the costs of
his prosecution, who shall not forthwith pay the said fine and the costs of
said prosecution, shall be committed by such Justice of the Peace to the
jail of Baltimore City until such fine and costs are paid, or until the said
person shall be discharged from such jail by the due couse of law.

division of this Article, or the State's Attorney, shall pray a jury trial,
the Justice of the Peace shall, in addition to his duties prescribed in
